I have read a lot of thread here and thank you to everyone for sharing such great information. I have specially been through the pinned show domicile when not living in the U.S. However my situation is very unique, which surprises me. I live 1.5 hours away from southern Ontario border and have a full time Canadian job. Can't I just claim that I will commute to my job after my husband's visa approval? I can sign a lease in Detroit across the border before the interview if needed.

 

I was thinking a tonne of people in southern Ontario region would meet the domicile requirement this way, but I don't see any such cases. Am I missing something obvious? What is wrong with my plan?

I don't know how they are doing things now with playing catch up from shutting down. Before they wanted way more then just proof you would move. Just claiming and not doing the other stuff pre covid would land you a big fat no from Montreal. 

 

I think (emphasis on think) if you went ahead and got the apartment. Change your DL to the US address and make sure you import your car and insurance. Then commute back and forth that would be enough. 

Once you do make the 'move' make sure your work switches you over to non resident taxes. (not sure if that is the right work). Also make sure you stop using the Canadian health care. Pretty much just go ahead and do all the stuff you would do after the move but do it just before the interview.

Lease and U.S. license are fine. How can I prove I have been commuting?

How does one do and prove that? Can one surrender their OHIP card?

Well proof of commuting would be easy for them if the border actually scans your ID on entry. I know they don't always scan it. Would you be keeping your Canadian job after you move and using that income for the affidavit of support? If so that would probably be enough. 

 

For OHIP just calling them will be  enough and they will take care of the rest. The reason being for stopping it is because as far as OHIP is concerned you can't be a resident in Canada required to keep OHIP and a US resident at the same time for proof of domicile. I don't know if they will send you a letter or not, can probably ask them.
