It all depends how much work you're willing to put in this case.

It's not 100% straightforward case bc a) the greencard issue b) overstay H2B

That being said, you're going to need to make sure you check and double check everything that the lawyer does. We see too many stories here that lawyers sometimes get things wrong (more often than I could ever imagine).

Good luck!

I’m a little intimidated by how to defend the use of gc if asked about in the interview. The overstay , we can handle and I know for a fact it’ll be forgiven. Maybe we’ll  consult a lawyer at least. Thank you for your reply.

There is no technicality involved.  You stated "She has a social security number but invalid now since her visa expired years ago".  That is inaccurate...as @Jorgedig correctly pointed out.

It is about technicality since I already said “I know” but here you are pushing for your “I know more than you do “ attitude. If you looked at my reply I also added “at least for employment.”   I was talking about how it is invalid for work purposes since her authorization has expired.

Hi, getting our paperworks in order to file for I-485/I-130. My spouse (beneficiary ) has overstayed her visa and used a fake green card to try to get a job. She has a social security number but invalid now since her visa expired years ago. I know that only false claim to us citizenship is inadmissible, but will her use of fake green card when she filled out an I9 to try to get that job result in a denial of her AoS ? Im at my wits’ end. Should we hire a lawyer for our case instead ?

I just wanted to say hey from Greensboro. This is definitely lawyer territory tbh with you. Where is your wife from if you don't mind me asking?

Language matters in immigration, you always want to make sure you are saying the right thing, and you should be thankful for the help and corrections you're getting here for free, good luck!

I was and I am but I won’t be corrected like I’m an idiot and know nothing especially if I’ve already said I was aware. Thanks for the good luck tho

I know it’s always in our best interest to assume that they already know this so there’s no point denying or lying, which we don’t intend to do. If we do it ourselves do we just submit the Aos packet with the waiver for inadmissibility ? Based from what I just read above, use of fake ID is not a ground for it. The way I look at this atm, we can DIY and pray to God it doesn’t come up. If it does come up, hire a lawyer that specializes in waivers. 😣 Thoughts ?

you can file the paperwork on your own. nothing difficult , just answer everything truthfully on the forms. Get a lawyer when you get an interview. Pretty good odds of some questioning at the interview

I think this is the route that we will go. I looked at the forms and they are straightforward. Thank you for your responding.
