Overstayed tourist visa

Timeline

My father overstayed his visa many years ago, sometime in the 2000s. He stayed like 3 years. Since then, he hasn't been back. I read that overstaying gets u an automatic 10 year ban which can affect your immigration visa. He is married to my mother who is the primary applicant for an F4 visa. Will this overstay affect him or is he good since it has been more than 10 years? 

 

Also, would they ask him about the overstay in the interview? I'm not really sure how he would answer because he was working illegally over there.

If it’s over 10 years since he left then yes he’s past any ban. He will need to answer the questions about his immigration history on his forms and in his interview truthfully. With the ban over it is unlikely to have an impact. Not really a significant difference between overstay and working illegally, both are status violations.

Make sure he answers everything on DS-260.  It will come up in interview at embassy.  How old is your father?  I have seen them be more forgiving when they are 70+ years now.

He is 58. By the time we even get through for an interview he may be 59 or 60
