Hello-

 

I am marrying my boyfriend in a few weeks. I just started working here in Texas as I moved from California recently. Before that I was unemployed due to covid and before that I was in school. Point is I may or may not qualify to sponsor financially but my future mother in law will sponsor as she's an LPR.  She makes way over the minimum and has lots of savings.

 

Is there a separate/different 1-864 for co sponsors? Or do we both fill in the same form?

Gosh, I linked the right form but called it the wrong name. It's I-864A :)

Why you may or may not qualify? Do you have job? Is your salary or yearly payment rate above 125% the poverty line? Can you provide an employment verification letter and paystubs? If so, you qualify as a sponsor.

 

If you want to use her income, she needs to file a second 864, not a 864a like mentioned above. She's not your relative, so she doesn't qualify as a household member.

If you make above the 125% poverty guideline, then you wouldn’t need a sponsor. Do you work? Can you provide with an employment letter and 6 months worth of payslips, together with your most recent tax return?

For peace of mind, your MIL can be your co- sponsor. She would fill out form I-864. If she’s living with somebody else, and that person is also helping her co sponsor, then that other person would fill out form I-864a.

If you want to use her income, she would be a joint sponsor. She files a 864 (not 864a). You need to include her tax return transcript and if she's married and file taxes jointly, you also need to include her w2.

We live  with MIL. She doesn't live with anyone. Only the 3 of us. I"m still unsure if she has to fill in i864 A.

 

Also-

 

Both my parents are in the military. I am not.  Is the multiplier different for assets if my income is not enough?

I posted 2 times that she fills out 864, not 864a. Read the instructions for the 864:

 

"Who May Be Considered a Household Member for Purposes of Form I-864A?

For purposes of this contract, one or more of the following individuals may sign the Form I-864A as a household member

if at least 18 years of age:

1. The intending immigrant, if the sponsor seeks to rely on an intending immigrant’s continuing income to establish the

sponsor’s ability to support the intending immigrant’s spouse or children;

2. The spouse, parent, child, adult son or daughter, or sibling relative of the sponsor, if that relative has the same

principal residence as the sponsor; or

3. Any other individual whom the sponsor has lawfully claimed as a dependent on the sponsor’s most recent Federal

income tax return even if that person does not live at the same residence as the sponsor. If more than one individual

agrees to help support the sponsored immigrant, each individual must sign a separate Form I-864A."

 

She doesn't qualify on any of them.
