I’m filing as divorce and 5 year rule.

No one was hurt at all. I hit the tree only and the Tree is still standing.

Being on probation means that you took plea deal. so in the uscis eyes that means its a conviction. Count 5 years back from the date of probation ended.  if the probation is in statutory period that can be used against you.

It’s in September 2016.

well it is recommended that the probation is not in the statutory period but the date you provided it looks like it is in that period based on 5 years.

At the same time you do qualify for petty offense exception. I wish you best of luck.

If you have any other question let me know. Make sure to provide ORGINAL COURT DISPOSITION in the interview, which has court seal on it. Dont give copy of court disposition on your interview day.

Dont pay any attention to estimated time. It will only make you go crazy.  It gives you an estimate when will they take next action. once the 14 days are completed it will change to we are taking more time to process your case. so dont pay any attention to it.
