Urgent - N-400 - ARREST!!!!

Hello all,

I'm new to this website but heard you guys help like a family. I need your help to fill the N400 Application. So I got   Dui in 2015,   and now I am filling N400 but while filing online they ask me the following questions:    YOUR ARREST HISTORY,   YOUR CHARGES HISTORY, YOUR REHABILITATION (ARD) HISTORY,  YOUR PROBATION HISTORY.  

 

Im little confused what I should fill when they ask me about the dates and other information??   I have Attached screen shot of my question and the following Information regarding my Arrest.

 

Arrested/Detained/Cited:   10-04-2015

Place of Arrest/Detained/Cited:   Miami, FL,USA

Court order (Charging sentence) for ARD:   03-13-2016

ARD completed  Date:   05-15-2016

Court Disposition:  10-21-2016

Probation was for  12 months  but after  6 months they  dismiss it.

 

Please help me to put correct dates and information in the form. 

 

I will appreciate your help.

I think you should write your arrest date which is 10-04-2015 in your arrest history.  Your location and why you were arrested is correct in all. 

 

For rest of the questions.... I think we need more input from our friends from this website.

I think the best thing to do is to seek legal advice. And definitely hire a lawyer. UCSIS very picky when it comes to problems with law. Even DUI can be a reason for denial. But what I was wondering is what is the time frame for putting all your history? Like 5 years... 10 years or entire time of your residency in the US?

A single DUI itself isn't a bar for N-400. It depends on whether you were convicted, how long the sentencing is, and this is your first DUI or not.

I was not convinced.

Sentence were for 6 month of probation and driving license suspended for 60days and ARD.
everything expunged in 6 months.

If you are filing n400 and still married to a US citizen, your statutory period is 3 years so count three years backwards which brings you to 2018 you should be fine since your arrest is in 2015. As long as your DUI does not involve moral turpitude. Have all the paper work, report it in your application and summit supporting document and have it handy when you get to the interview. Explain what happened and the court disposition and that you were sorry took alcohol classes, and you fixed yourself and nothing has happen since then and it will not happen again. You should be fine

I’m filing as divorce and 5 year rule.

No one was hurt at all. I hit the tree only and the Tree is still standing.
