Health Insurance while AOS in US

Hello again VJ family-

 

I was wondering what kind of medical insurance we can purchase. We are getting married in 3 weeks. I'm USC, he is from Canada. He came in on Dec 26th. He currently has visitor's health insurance through his father's benefits plan in Canada but since he will be adjusting status here here I'm thinking he is or soon won't be covered under that Canadian plan. 

 

So what kind of plan could he be eligible for as a visitor here who will marry and adjust status in the US? Also looking to satisfy the i-944 requirement.

Couldn't you add him to your insurance?

 

Also, if you are no longer filing for a spousal visa, could you please correct your profile when you have a chance? I was wondering why you thought you had to adjust status.

I am filing for AOS. We're marrying in 2 weeks and then sending off the paperwork. Not sure what I have to change on my profile

I see you have changed it, thank you it will avoid confusion.

 

What about adding him to your health insurance?

I just started my job so I'll look into it. But the i944 is not a requirement so we can take our time about it now. He doesn't have a social so I"m not sure if he can be added

You should be able to add your spouse to your insurance, even if they don't have a SSN, as it's a qualifying lifetime event. I've heard some insurance companies are difficult about it though

Re taking your time about it: can you afford out of pocket costs if he is an accident? 
 

SSN is not required for insurance. Many dependents on work visas don’t have SSNs but have health insurance here.

1. Getting married is a qualifying life event (QLE) and your employer's health insurance plan has to let you enroll your spouse  if it is covering spouses. HIPAA act.

 

2. If your spouse does not have an SSN, by law your employer cannot deny health insurance to your spouse. On the flip side, once your spouse gets an SSN, you have to tell your employer what the SSN is.

 

3. Your employer might have domestic partner insurance. Your domestic partner's move from another country to the USA might be QLE under your employer's plan. It was at my employer, and so I enrolled by then fiancee for a few weeks as a domestic partner and had her insured as such until we married a few weeks later. Then switched her.

 

The rules and deadlines for you notifying your employer QLE can be strict and often it isn't obvious how to do so (my employer uses workday which is a brain damaged user experience IMHO, and I didn't get it right. Luckily my employer conceded that I did notify it of our marriage and I was able to save a few dollars by moving my wife from domestic partner to spouse status).

Do you think he would qualify under his mom's insurance? My insurance is not great but his mom has really good insurance through her employer (government) He's 19.
