Timeline

Maria arrived in USA yesterday. Today we went to Driver License Bureau to get her a State ID Card. They said they cannot issue one until we recieve Social Security Card. So we went to the Social Security Office to apply for a card. They said they cannot issue her a card until we have her green card.

What are we suppose to do. We understand that in order to get married we must have a ID Card. Will they accept her Russian Passport. We are getting married in Eureka Springs Arkansas. They have no waiting period. So we plan to get married this weekend.

I am starting the process of filing AOS as soon as we are married. It is so wonderful to have her here but we are frustrated at the momment.

K-1 Visa holders are entitled to receive a SSN card. You need to wait for 2 weeks before you go to the SSA office to apply to make sure she is in their system.

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

Try another Social Security Office or talk to someone higher up because from all i have heard k1 visa holders can be issued a social security card. there's been a lot of posts for people having problems getting a ssc on k1 but u can do it. this link proves it

Hey you should try apply again for SSN in another office or just try again with different person.

I came here on K1 visa.i get my SSN after 2 weeks.When I came first time to the office they said that i need employment authorization(bull***) to get SS card.I came back whit printed rule from their side that i can get SSN without EAD.

End about ID when you want to get married...hmm you have to check on the www what documents you need.When i was getting married(Chicago) i have only show my birth certificate and passport :D

And about AOs process ...you can start it if you will have marriage certificate, basically you wait for it for one week to three weeks this depends from region.

EM-00154

The EM-00154 memo states: "A nonimmigrant alien in K-1 alien status is authorized to work based on that status and is no longer required to show and employment authorization document (EAD) as proof of employment authorization when applying for a Social Security Number (SSN) card." The memo further states: "When an alien in K-1 status applies for an original or replacement SSN card, accept as proof of employment authorization either an unexpired:

* I-94 showing the alien is admitted as a K-1 for a 90-day period; or

* EAD (Form I-688B showing "274A.12(A)(6)" on the face of the card under Provision of Law or Form I-766 showing "A-6" on the face of the card under Category).

The memo also states: "Some I-94s issued to K-1s are stamped or annotated "Employment Authorized," and some are not. Either way, the I-94 is proof a K-1 alien is authorized to work." The memo is File no. EM-00154 dated November 1, 2000"

First paragraph - "This Emergency Message replaces EM-00009 which expired in September 2000 and POMS instructions, RM 00203.500C.2., for K-1 aliens. A K-1 alien is the fiancee of a U.S. citizen"

Second paragraph - "A nonimmigrant alien in K-1 alien status is authorized to work based on that status and is no longer required to show an employment authorization document (EAD) as proof of employment authorization when applying for a Social Security Number (SSN) card."

print out http://www.kamya.com/ssn/em00154.pdf and http://policy.ssa.gov/poms.nsf/lnx/0100203500 and take them with you to the SSA office....nothing like pointing out their own policies to them in writing to get them to play ball. One word of advice though..wait about 2 weeks from the time of entry before trying again to make sure all the information has been transferred from the immigration computers..otherwise the social security application will be stuck in manual verification hell for weeks and weeks.
