hello all. I am filing a 601A waiver, my husband is petitioning for me. I have been in the US since I was 2 years old. I am now going to be 26. When I was 18 I got a misdemeanor for marijuana. I got a plea of abeyance and the charges were dismissed. If my waiver is approved I am worried abt going to cuidad Juarez and this causing an issue. Has anyone dealt with anything similar? I also got into some trouble a few times as a juvenile. Not sure if this needs to be disclosed to USCIS. Thank you all

The CO will review your criminal history and determine if a waiver is needed

All arrests, criminal charges and judgements need to be disclosed to USCIS,  even if you were a juvenile at the time.

hello all. I am filing to hopefully get a Visa. I’d have to do a consular appointment in ciudad Juárez to get my visa to enter. my husband is petitioning for me. I have been in the US since I was 2 years old. I am now going to be 27. When I was 19 I got a misdemeanor for marijuana. I got a plea of abeyance, after pleading guilty and the charges were dismissed after I did some drug testing for a while. Currently we are gonna file a waiver for my unlawful presence, 601a. If my waiver is approved I am worried abt going to cuidad Juarez and the marijuana misdemeanor causing an issue. That was almost a decade ago.. but I know it can make me inadmissible anyways. Has anyone dealt with anything similar? How did the process go?? I don’t want to have to stay in Mexico for too long as we have a daughter in school here and also a 3 year old now.

I also got into some trouble a few times as a juvenile but my attorney says that shouldn’t cause any issues since I was a kid. Thank you all

I was hoping you would get a few responses from VJ members who have been to CDJ with similar facts..or those long time members who read most posts….maybe try Facebook groups en español (?) 

 

 

But here’s my 2 cents

Sounds like u were told that your I-601 A will not have an issue w misdemeanor and USCIS will not poke about juvi records….

 

 BUT, were also told of  risks  of CDJ revoking the I-601 A & getting stuck there ….because your conviction is for Drug Charges…AND for immigration purposes still counts ( notwithstanding abeyance/diversion/..) 
 

ITS SCARY, I agree. 
So hopefully your attorney had others return w no problems …and it may be good to know if he sends a a truckload of “rehabilitation “ and brief WITH his clients for the interview OR sends nothing and wait and see. ..

Rehabilitation would be something to be included in a I 601 package.
