Should ex-living relationship and biological child be included ?

Hi

 

I got divorced in 2014 in my home country outside US and have the court's divorce decree.

 

Later, I cohabited with another partner in my home country outside US for few months during 2020 and she got pregnant and delivered a child. We are separated & had no intention to marry.

 

I can't apply for divorce with my live in partner as there's no formal relation between us and not applicable. 

 

Also, the state in US I'm applying doesn't recognize common law marriages.

 

I'm currently in process to marry a US PR holder, could you please clarify following doubts:

 

1. In marriage license application, there's no provision to fill ex-live in partners so, will no. of divorces be 1?

 

2. In form I-130, no. of children include step children so, can I fill my child details as I'm the biological parent?

 

Please help as I don't want to fill wrong information.

If you were not married to that person, there is no marriage or divorce to include.

 

Your biological children will need to be included.

Also - if you're not even married yet, aren't you jumping the gun a bit here?

ALL children,  both in and out of wedlock, are included

Bigamy is when you're married to two people, right? So since you're not already married to the mother of your child, it's not bigamy. Adultery is cheating on your spouse, so since you were not married when you had your previous relationship and conceived your child, you did not cheat on your current fianceé.
