Need Advise

I've got my email from the embassy (January 2021) to complete all the documents needed for the interview including medical. They said I need to complete four months from their first email. Due to covid and everything going on I think I need more time to do that.

1) Does anybody have experience extending their case status in the embassy?

2) how long can we extend considering that my file has been exceeding the validation date months ago due to backlog in NVC?
3) what if I must delay my arrival in the U.S, is there anything I can do?

The  reason why these questions appears is that I don't think I can travel around September/October (IF I do my interview got approved in April). What should I do?

Discuss it with those that matter.  The consulate!

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Hello,

 

I assume it has been a long journey for you by this point.  If you truly cannot arrange your affairs in time (4 months from Jan), then contact your embassy to see if they can extend the validity of your K1 petition.  They may be able to extend it for another 4 months, or they may not.  It would be better if you try to get your situation sorted within the time period (6 months from the date of your medical) to avoid delays or even the possibility of having to re-file.

Hi, thank you for ur response. I did tried to call embassy they said to reply their last email and tell them what my situation. I try to get everything done within the time period but in the end it seems hard for me to leave the country due to work obligation unless during Christmas and new year long holiday.

Hello,

 

Your comment about "work obligation" is confusing.  You do realize that as a K1, you are intending to immigrating to the US?  You cannot work, even for an overseas company, when you arrive on the K1. Part of the K1 is to quit your current work, go to the US, get married, file for EAD and AOS, and then work for a US or other company after getting your EAD.  If you want to keep working for your current company, then a CR1 would be better, or perhaps have your fiance immigrate to you?

I know it's a bit confusing, we do have several options one of them is married then apply CR1. It's hard to decide especially I just got promoted recently and I think it's a good experience for me. We can't just abandon K1 bc we need this to get married since my fiance can't travel to Indonesia due to travel restrictions. So the only way to get married is I travel to the states.

You don't need a K1 visa if you're only using it to marry in the US then going back to Indonesia. You can come here with a visitor visa and get married, then go back home. The K1 visa is for you to move to the US and stay, then like SteveInBoston mentioned, you can't legally work for any company (even one outside of the US) until you get your work permit. I'm not sure of the exact time limits, but if you leave the US after getting married on a K1, you could lose it. I know you can leave for a short amount of time after you apply for advanced parole, but that takes a little while to receive as well.

Hey thank you. I know we still sort things out. I just hoping by the time that I should leave for k1, I'm able to go. Indonesia still closing their borders.
