oh just seeing this, we didn't involve the court so far regarding the child. That would probably bring more complications and things are going good with the current arrangement.

As long as you understand that in this case, the child will have to wait until she is 18 and apply to naturalize on her own, and will not be able to derive citizenship from you when you naturalize. Please ensure you keep up to date on her green card renewals until that happens as well as keeping all documentation that she will need at that stage.

If you are CR1 unfortunately there are no derivatives allowed on that visa, so you cannot bring him any of the ways you mention above. However your spouse can file for a CR2 petition for the baby. You may want to delay your interview so you can both get visas together.
(I am assuming that your USC spouse was not able to pass on US citizenship to the child or this wouldn’t be a question?)

As we always say.... The immigration process requires a great deal of knowledge and planning.....along with time, patience, and money.

So your child was born the same month you got married? And your USC wife was ok knowing you had someone knocked up before your marriage? Which consulate are you interviewing at?

Child was born a month after I got married, my wife wasn't thrilled but she accepted the situation. I was not fully aware of the child until later in the pregnancy,
