I am USC petitioner and we had interviewed for the K1 and K2 visa ( beneficiary's minor daughter)  in Jan 2021.

We were asked for more documentation under 221 G which we submitted and  are waiting for our 221G result.

We have been waiting for 7 weeks already and I understand that the 221g time frame is unpredictable.

 

My fiance (beneficiary ) is in India and is pregnant with the due date in end of August.

If we get the visa approval after July we would like to travel to the USA only after the baby is delivered in India.

I would think that I can apply for baby's USA passport in US-consulate in India and when the baby is a couple of months old , we all can travel back to USA.

Is there any problem in doing so?

That's  NOT how it's done as the visa would also expire and would need to be reissued and the consulate may or may not be willing to do this

Why would the VISA expire? Does it not have a validity of 6 months for entry? 

If the visa is issued in July and we travel in early November - possible?

You were speaking about getting a new medical,.  The only reason to get a new medical is if it expires (6 months).  If the medical expires,  the visa expires on the same day.

I see, so is there any way out of this? if we were to travel after the baby is born ?

In the same way, you wait as long as you can before getting it. 

 

The visa expiration is tied together with the medical.   The medical is the hard date that you must manage.  If the medical is two months old at the time of visa issuance,  the visa will only be valid for 4 months.

well I would have loved if I could "manage" any portion of this  visa process :) ; .

I really appreciate any other thoughts on this.

You can delay obtaining the medical and police certificate if you wish.  We did so for another reason awhile back (approved too fast, not ready to return to the US)

The CRBA process (for the baby) is quick and easy.  You apply together, and burden of proof is on you (USC) to meet the physical presence requirements.  I grew up in the US and had difficulty with that - provided college transcripts and old passports which they finally used to establish (my) US presence.

Thanks for that useful info.

We already have the medical reports that we presented at the interview... they are only valid till july 1st week... is there a way to have those redone?

What was the 221g for?

 

If you are getting that close to the July 1 date and the visa still hasn't been issued,  the consulate will likely ask for a new medical in order to reset the clock

That would be great if they do ask for it; Do I have just keep sending them emails to let them know the situation?

So far I keep getting standard response saying that the application is under process....
