  There are other factors in a criminal charge. The law basically recognizes that hate crimes are pre meditated crimes based on the perpetrators inherent bias. It's not divided into hate crime vs non hate crime. Other murder charges don't all get the same sentence.

  It does happen, but the charge as a hate crime is not a distinction made based on whether the perpetrator hates the victim or not. It is a charge made when the crime itself was motivated by the perpetrators inherent bias towards race, gender, religion etc.

It seems to me people conflate hate crimes and regular old fashioned murdering in an attempt to shift away from something they feel uncomfortable about... and I don't know why. Just because the end result is murdering someone does not mean there isn't particular types of intent behind it. In a civilized society, we recognize the various intents behind a crime, especially the most heinous kinds. Like I said, unless they come up with evidence more specific, it would be hard to prove this guy's intent was to kill Asians. But, I think it's clear his intent was to kill women, and women in this occupation specifically. His hatred and motivation was a hate crime against women and what they represent to him. 

 

I read an interview with the son of one of the victims. It was pretty clear to him what this was all about, but moreso he had wise words for his young age towards the killer's parents. He feels their behavior in raising their son was a contributing factor.

 You are having difficulty because you still fail to understand the actual concept. The charge of a hate crime doesn't mean he hates the victims. It means the crime was motivated by a specific bias or prejudice and he targeted his victims because of that. In this case, he has already admitted what that bias was. It's not that difficult, I'm not sure why you are trying to make it so.

He hates men, or people who identify seemingly as male.

  Yeah, I'm starting to see some of that shifting. It's pretty clear who was targeted and why. I think the concept of the hate crime charge has been explained enough times. It's weird that people are going out of their way to explain away this guys actions. My empathy is for the victims.
