Hello - I am new to this, and must admit that I am only becoming more and more confused by reading information posted on this forum. My questions may be a bit elementary, but I can't seem to get a straight answer anywhere else, so I am hoping someone here will be able to give me some guidance.

- I am a US citizen recently married (June 22) to a Danish citizen. We live (and were married) in Italy. I am sending the I-130 to Rome tomorrow. I understand that I then have to wait until I receive an approval from them, which I have been told could happen in just 2-3 weeks (is this true?), and the petition will then be sent to Naples. What happens then?!? Should I file a 129F immediately? In the US or in Italy? What are the approximate timelines in Naples?

I may be wrong here, but if you are bringing your wife to the states, then you would file your I-130 with the U.S. Government. Now I may be wrong if Rome works differently than others, but as far as I know you would have to file it here in the USA.

Now you cannot file your I-129F until you have the Notice of Action (NOA1) from the government stating that they are processing you I-130. You have to fil that first and wait for the NOA1 before you can move on to the I-129F.

And I would expect a much longer wait than 2-3 weeks. See my timeline below.

I take it you are planning to do a Direct Consular Filing, or what we refer to as DCF. If so, it will result in an immigrant visa, usually more quickly than a K3 visa could be obtained. In that case, there is no need to file an I-129F at all. You might want to check out the DCF forum (look down two spots from the K3 forum) and ask your DCF related question there.

Have you checked to see if you qualify to do DCF?

Thank you so much! I have been calling the USCIS customer service line in the U.S., as well as immigration lawyers for months now, and no one has ever mentioned DCF to me! This was a huge help!

If both you and your husband have legal resident status in Italy (residency requirements vary, so check with Rome), you are eligible for DCF; and it is way quicker and less painful than going through the NVC. Good luck!
