Hi ,

 

I (U.S Citizen ) have filed I-751 application with my spouse ,we submit every single documents such as our child birth certificate ,joint taxes ,joint bank statements ,family pics ,health insurance ,joint club cards ,joint utility bills ,medical bills ,our child pediatrician summary visits accompany by I and my wife. and so on but what i didn't submit was my mortgage document as house is on my name (which i bought before our marriage ) and I just didn't bother to add my spouse name because her credit isn't good yet and we thought we can buy another house on her name as first buyer so we only have to put 5% down . My concern is it mandatory to have spouse name on house mortgage for I-751 approval ,I saw some youtube videos and they mentioned that in interview letter they asked you bring documents which you haven't submitted with your I-751 application ,in my case mortgage document .And then if you don't produce joint mortgage document they will deny your application .Does anyone have experience with that kind of situation or should i just have her added now .If this is something which they think is must have then i can contact my mortgage and have her added ,if not then for reasons mention above ,I am thinking to keep as it is so we can buy another home on her name in future.

No.  It's not mandatory to have your spouse on your mortgage.  

 

For the I-751, you are providing evidence of a commingle life as husband and wife.  Nothing is mandatory. 

Some things are more common than others.  Some people keep separate bank accounts.  Both names may appear on utility bills.  


Not unusual for assets acquired before marriage to remain separate property; especially when there are kids from prior relationships.

Thanks for your feedback ,that's what i thought .I mean in interview they can ask any questions to validate if we are living together or if our marriage is bonafide but I was just worried if they can deny our application just on the basis of not having joint mortgage or lease documents . As i was watching some people previous experiences and they said they send you a interview letter with any require documents which you initially haven't submitted (mortgage or lease document in my case ) and they can deny your application if you don't bring those documents at the time of interview .

Thank you for your feedback and clarification this means I was just worried for nothing .We did also sent our both driver license showing same address .

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

My mortgage company said to do this i would need to refinance and pay new closing costs so  i just did a quick claim deed for that i typed myself and added his name to deed and property taxes

but i did this to show commingling of fiances for the visa to be approved

It is not necessary and it is very common 


Adding her to the deed is easier and more straightforward

We went through the ROC process in 2013 but my wife was not on the mortgage on the house we bought after we were married.  She was on the deed.

 

What I have found was when you have a new(er) SSN, it complicates most financing for homes, cars, etc.  No car loan we have taken out in the last 10 years has she been on the note even though her income is now a significant part of our family income.

 

Just refinanced last year and she is now officially on the mortgage after 10 years of marriage.

I am in the same situation as my spouse is not on the deed or mortgage as I bought the house before she came to the US. Ever since she started working in the US, we have been paying for the mortgage together from our joint bank account. There is a monthly payment that goes out from our joint account in which we both contribute. Is that okay? I was looking into doing quit claim deed but not sure if that’s necessary. We are filing in two months.

Not needed. 

 

We were in the same situation - husband bought a house and got the mortgage before I arrived and we had no issues with my ROC. We just highlighted mortgage payment from the joint account - no issues at all.

This is OK, you shouldn't have any issues. Is your spouse listed in your will? How easy would it be for spouse to claim ownership of house if you suddenly die? That's the only concern and it's outside of immigration scope.
