Okay thanks I see it

Just answer that question honestly. DS-160 is used for all non-immigrant visas, so while deportation from France may be an issue for US tourist visa (*see INA 214(b), etc.) it's not an issue for your K-1.

Hello everyone.

In 2015 I was getting a spanish visa chingen  I was entere to spanish and go to french and my visa was expired there in french and I stay there for 2 years until French back to morocco because I don't have any regular Id and I'm living there  illegal. So I was back to morocco in 2017 .

Now I meet my girlfriend and she wants come to morocco for visiting me and she tell me for we get married and we apply for the k1 visa .

My question is . If I apply for the k1 visa I will have a problem because I was living 2 years ilugalillegal in french ?

And I should say that I was living in french in the document we will applying for visa k1 ..

Hope you will helping me and thanks .

I agree that you have to be honest.  They will discover everything eventually.  The bigger problem is not that you were deported from France.  The bigger problem is that it look like you really don't want to live in your country.  You were willing to live there by breaking the law.  They are looking for possible marriage fraud, where someone is just marrying to leave their country.  So there are some things that you need to do:

1. Establish a life in Morocco.  I don't know what your situation is, but I know work can be difficult to find in Morocco.  If you cannot find work then try to take some classes or even do like volunteering.  Get busy there so that it looks like you are not desperate to leave.

2. Do not get married the first time your girlfriend comes to visit.  It will look like you are moving too fast.  If there is an age difference between you and your girlfriend, it is better to do the marriage visa, the CR1 visa.  It is more sure.  Have your girlfriend visit at least 1 or 2 times before you get married.

3. If you insist on getting the K-1 visa, make sure she visits a few times before you apply.  Time is your friend in this situation.

4. Try to take screenshots of your chats from the beginning.  You want to show the progression of your relationship.  Don't take screenshots where you say "I love you".  They will want to see a slow progression of a relationship, not I love you right away.

The good news is that you entered France legally, you just stayed too long and your visa expired.  Fortunately also, it has been four years since that happened and by the time you apply for the K1 or CR1 it will be longer.  If you get your life established in Morocco and if you know your girlfriend for a longer time before you do the K1 or before marrying, you have a much better chance at being together.  Best of luck to you!
