I am a US citizen and My son is 7 months old. I have filled a petition to have him come to America with me. I do not meet the requirements for CRIBA. Has anyone gone through this process for Minor child. Can I get some details on the process and some tips. Also is there anyway to expedite the process. 

What kind of details are you looking for? You’ve already filed the i130, correct? You won’t need an i864 as the child will automatically become a citizen when he enters to live with you. After you enter the US you can apply for a US passport for him.

If you lived in the US for 5 years, then why can't you pass US citizenship on to your son?


Why did your LPR wife leave your son behind after giving birth abroad?

 

At USCIS, you can ask to expedite the I-130.  At the NVC, you can ask for an expedite there.  At the US Embassy, you will need to ask for a third expedite.

Thank you. Yes I have filed the i130. Ok great. Do I have to submit an i864w?

My LPR wife didn’t want to stay out of the US for more than a year so she went to America briefly. We were not aware that she could have traveled with the baby. Biggest mistake! 
 

sorry typo. I have not lived in the Us for up to 5 years so I don’t meet the physical requirement

Where is your, or her, home in the US?  How long has she been out?

Your son will never receive a green card,  he will become a US citizen immediately upon admission
