However, some U.S. states have adopted "remote" notarization, by video and with process safeguards.

Do a search for "remote notarization in [your state]" to see if this applies.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

120... 130...140...150 days and nothing, no words from them, I tried twice to get infopass appointment and even talking with a 2nd tier Officer, nothing... till I contacted the congressperson again, and they said, I will help you one more time, after that we will have to keep waiting...HUGE help a week later... case approved and updated almost every other day till today when GC was delivered... I am so so so excited, GOD is everything!!!

end of 10/2017: interview based on I485 (ex) husband didn't show up, showed the vawa package sent already. I485 put on hold

11/02/2017: I360 case received

01/31/2018: RFE good moral character 

02/15/2018: RFE received

05/01/2019: we order a new card

05/06/2019: card mailed EAD C31

05/08/2019: EAD C31 on hand

05/23/2019: I360 case approved

11/18/2019: I485 case transferred 

12/27/2019: RFE base on I485 sent ( never received)

02/2020: Infopass appointment finding out about the missing RFE, my case was in another office, no the original one.

04/17/2020: interview scheduled got canceled due to covid

10/21/2020: Interview (medical up to date)

04/07/2021: ordered a new card

04/08/2021: case approved I485

04/12/2021: mailed a new card

04/15/2021: GC on hand!!!

I had many EAD, always updating them!

HI VJ Fam! 

Hope you all are well. I have some confusing, technical legal questions. Dear @sandranj I really need your help in this! @TBoneTX @Stillwinning!!!😊 please share some knowledge if you have to! I am in removal proceedings and applied vawa mid 2019 still no update. My file is in status docket now with the immigration judge and My questions are :-

1) Do I have to apply for vawa cancellation of removal as part of the whole process anytime in future even if my vawa gets approved?

2) Do I have to attend the longer individual hearing in which testimony is taken regarding the cancellation application?     

3) I did little article research and read that "If the application for cancellation is ultimately denied, the immigrant will be ordered removed and deported from the United States.

Say my Vawa gets approved and It is required to apply for cancellations as part of the process, is there anyway that the application can be denied even after the vawa approval as stated above in bold?

Before the legal crew steps in, I’ld  like to say I believe the answers to question 1and 3 are Yes respectively! Good thing you have an attorney...once your i360 is approved, it’s easier from there!😊👍

1. No, you can just file I-485 directly with the judge. COR only really comes into play if you're in a position where you are not otherwise eligible for AOS (e.g. you have a permanent bar), or ineligible for an I-360 because it's been more than 2 years since divorce, you were abused by a parent and aged out by turning 21 and can't argue that you didn't file due to factors outside your control, or you were the parent of an abused child you had with an abuser you weren't ever married to.

2. If you file a cancellation application yes, if you pursue an I-485 instead that's still a yes but the hearing will only deal with matters of admissibility rather than eligibility.

3. COR is pretty much a separate process from VAWA I-360. Now, if you manage to convince USCIS that should hold some weight with the court, but the court at the same time isn't bound by I-360's approval in COR cases. It's also not so much that COR denial leads immediately to a removal order, it's more that during the process you can seek relief from removal via various means (I-485, COR, Asylum, U-visa, Withholding of Removal, etc) and if you exhaust all the avenues you have and it's just straight up denial after denial the court ultimately will order you removed as there's no reason to keep proceedings open if there's no way left for you to win.

 

tl;dr file I-485 with the court and forget about COR unless you're ineligible to do an I-485 for some reason

Very similar timeline as mine.. whole process was more than 3 years for me as well

Wow! March 2017 filer? I won’t be surprised if your file was lost. Sometimes it can happen. I really hope you hear good news very soon 🙏🏻

most of the times they do it on the EAD card. Known as Combo card. however, sometimes they do send it separate.

Mine first one came as a combo card. seconds both came separate.  Which is not a big issue.

When I was reading your post my heart was popping out , but I’m also happy for you because you bought a house and  you have a job , these things will keep you in motivation.I wish everyone can reach their goals as you reached some of your goals .The light not too far from us , our Lord is showing us the light.soon he will show end of the tunnel ..
