Wish you good luck, Wish you will post soon  about your vawa approval, I saw many posts when appealed 2-3 times and they got  approval

Hi,

please I have a question I need help.

I had filled for my green card first with my husband in 2018 and got denied in 2019, due to misunderstanding in the first interview my husband was rude to the IO and I think he had taken it personally, forwarded our case to another immigration officer and we were called for our second interview on getting there my husband refused to answer any questions from the IO because he was demanding right there that the interview was impromtu (they had called us on the phone to come in 2days later)and our lawyer was not available, he was asking them to give us another date. So he got in an argument with the IO. Long story short, his short tempered. When we got denied we had appeal the case and I was going through hell in the marriage, consulted another lawyer and she advised I filed vawa.

My question is I have a pending case currently in the BIA, and also I already filled for vawa, I haven’t heard anything from the appeal case yet, please do I withdraw the appeal and focus on the vawa? 
2nd question, am still married to my husband but I had moved out recently after filling the vawa, can I file for divorce already? It’s been 5months. Thanks please any suggestions?

PRIMA FACIE RENEWAL QUESTION
 

Hey everyone! I was told that a new prima facie is mailed to VAWA applicants when it is about to expire and your case isn’t approved yet. The person who told me that said there is no renewal process like the EAD for instance. However,  another person just told me that I need to request a renewal. I am now confused! Does anyone know how it works?

If I need to renew, what’s the process and how long does it usually take?

Normally they will send you a new PF automatically. However, they sometimes don’t. In this instance, if you have need for the PF you can certainly write a letter to Vermont requesting for a new PF. 
 

In my case, I requested for the second PF which they sent. By the 3rd, they automatically sent a new one without me requesting

Typically they send it to you before or after the expiration of the first one. Like mine i got last month before the first one got expired. Some times people get it after the expiration of first one. USCIS send it automatically. 

However, If you using it and need to get the new one. You can write to USCIS and request to have you send the new one.

There is no application that you need to fill out. Just write to Vermont with the copy of your VAWA petition.

You need to write to vermont and they will issue you a new PF

How does terminating proceedings look like these days? I tried to poke around and it looks like the things that Sessions decreed back in 2018 while he was AG in Matter of S-O-G- & F-D-B- are still controlling, i.e. you pretty much can't get a termination except under really specific circumstances.

I got my cousin who got termination in 2 months. He was in immigration proceedings, went for his marriage interview. His case couldn't be approved on spot because he was in immigration proceedings. His lawyer filed a motion to terminate after , it was granted fast and two weeks after,new card being produced. This is chicago court. This happened in the last 3 months. His green card came in two weeks ago

So VSC will still transfer your I-485 to NBC or your local office  before termination of removal proceedings right? 
 

do I have to wait for I-360 approval notice to begin the termination?  What is the termination processing time? Thanks

I am planning on going back to college and hopefully the PF can help me pay in-state tuition. 
 

Does anyone know about that by the way? Do schools have to consider us as “residents” if we have a pending I-360 and I-485 applications, plus a valid PF and we let them know about it?

Yes the PF will help pay in state tuition and you can also get student loans if needed. I am in school and I am paying in state tuition, got pell grants and student loan with the PF and I485 documents
