Thank you for your answer. Will they ask you if you are still married and/or where are you living? Do you need to explain when you are divorcing?

yeah they asked me when i got divorced, and if i was divorced before i filled VAWA. And asked me if i had any kids, which i told them i had 3 kids now after i left my ex.

Hi AA,

If the vawa holder is still married when they file the i360, does the IO expect them to still be married at I485 interview?

So basically if Vawa is approved and we have pending i-485 then we can pick whichever category we want?

In that case if we apply under c31 would it be free or we have to pay for that?

C31 the initial one is free. C31 renewal you have to pay for or get a fee waiver.

C09 initial and renewals are free, unless you got a fee waiver for the I-485, in case of which you need to either pay for renewals or get another fee waiver for each renewal.

Yes, you get to choose if you both have an approved I-360 and a pending I-485.

No. You can divorce or remain married just fine. They might ask questions why you haven't divorced yet but it's more curiosity of the individual IO rather than a matter of eligibility.

Only thing you can't do is re-marry before the I-360 is approved.

hehe heck i was nervous when they asked me about kids part :D haha. But they said they might send me a RFE or make a decision after the interview. So i'll see what happens, i didnt bring a divorce paper with me to the interview which they asked for it. Guess i didnt anticipate them asking for it.

Just an FYI, once your Vawa is approved. Don't wait for the court hearing. File for a motion to terminate the court hearing. If granted you can directly file for the i-485 with USCIS. I was in a similar situation and I was able to get my hearing terminated. Good luck!!! 😇

If I do not receive the receipt  in 4 months for AOS , should I re-apply the AOS again ?

I would suggest reaching out to ombudsman cos that is what they primarily do.

when I applied for my I-360 it took 6 months to get the receipt notice , after 4 months of submission I had to reach out to ombudsman who helped me get the receipt number before Uscis sent me the notice by the 6th month

Hi guys! Congrats to all of you who got an approval and for those who is waiting for approval I just want to say that it will come one day you won’t even expect🙏🏻

As mine came!

So my VAWA been approved from November 2020 and USCIS again messed up with a notice. I still didn’t get it.

But. I got an invitation for interview for

I-485😱

Guys!
What I need to do with medical exam?

So. Ours is definitely old. In the notice it’s saying:You must bring...

”A completed medical examination (Form I-693) and vaccination supplement in a sealed envelope (UNLESS ALREADY SUBMITTED)

We have submitted it when I was applying with my ex husband back in 2018. It old.

So my question is:

1. Do I need to provide new medical exam?

2. Do I need to do new vaccines? I guess I had documents about doing it. But if I’m mistaken can I get them in the office of civil  surgeon?

3. What if civil surgeon won’t have a time available for an appointment?

Can I send the message exam later?

Thank you very much in advance!

I have just one months. Need to complete everything quick.

You should bring a new medical exam.Your medical exam  was done over 2 years ago.If you have proof of the vaccines then you don't need to have the vaccines again. You will find a doctor available, all cities have a lot of doctors authorized by the USCIS.If you bring the medical exam later the officer will not approve your AOS on the spot.

You don't have to be married to attend the AOS interview.
