Today I received a Request for Initial Evidence and I am feeling a bit brain scattered. 

Here is my timeline:
 

April 2019 - Applied I-751 Waiver to WAC 

May 2019 - 18 month extension

November 2019 - Fingerprints applied

April 5- Request for Initial Evidence

 

The waiver I applied to was based on the sexual and mental abuse from my spouse, as evidence I attached multiple texts, emails, 2 affidavits from close friends, my statement with timelines 10 pages long, as well as my daughter was the main witness to the situation that was going on at the time. 

in the Request for the Initial Evidence they say that there is insufficient evidence of abuse since there is no police records or court records. My divorce is still pending but should be completed before May 13th. So here are my questions: 

1. How can I switch to divorce waiver (or at least include it as well) in my case if I have the final divorce decree before the deadline for RFE

2. If I am unable to switch to divorce waiver, what else would you recommend me to do to proof such cruelty as sex abuse? 

To prove mental abuse, you need a psych eval

Phase I - IV - Completed the Immigration Journey

Got it, so if I passed the AP expiration date, would my whole I360 and I480 case be canceled? Or if I360 still can be processed, then I need to refile documents outside US in my base country?

Hello what’s going on ? How was your vawa denied ? Sorry for that !! That was a tough one !! Can I know what you submit for your i360..have you ever gone to interview with your spouse before ? What did you submit for the i360 as in what are the documents that you submitted ? You can file you case with the BIA ...vawa officers are always strict in approving men ,it’s only women they approve easily ,most men had to go extra mile before they can get approved only few men got it right easily !! So can we know the documents you submitted and how many months did you live together with your spouse ? Sorry to hear that !! God is your strength!!!

My advise to All the male vawa filers is to always fight their case to the end cause it seems like they always give male vawa filers unnecessary hard time that Dnt worth it ,for some reasons we dnt know those guys in vermont always Want to act like they know what they are doing but in most male cases they suck 😂😂😂😂😂 so if you are a male filer fight your case to the end ,never give up ..they will tell you that men could also file for vawa but when you file it they will be so hard on your case ,so never give up !! If you know you have case fight it till the end ,those people working at vawa vermont are also immigrants one way or the other ,their fore fathers are immigrant so Dnt let them make you lose courage ,if they deny you go to BIA as long as you have you proofs ,we have seen so many cases that got denied by all these lazy guys are vermont and got approved by BIA..as I am right now am expecting positive result and at same time am fully prepared to fight anything that comes from those guys in vermont 😂😂😂😂😂 cause some times they dnt know what they are doing and they always want to make case tough for we men ..most people that got denied for no reason that I know are men and most of them fought hard back for their case and got approved by BIA..most women dnt even have shared residence or Joint bank statement but they will approve them but when it comes to men case they want to watch your relationship In the cinema  How your wife abused you..so my advise for some guys out there on this forum is not to give up ,have given you the clue ..fight your case and Dnt mind those guys I’m vermont they are jokers 😂😂😂😂😂😂 Dnt let the discourage your hopes ..fight till the end so far you know you are Truly abused by your wife ,most especially if you have attended any interview with her !! Sit on your case and fight hard and pray to God you will get victory,Dnt let all those lazy guys at vermont kill your spirit!!!! If you have any police report about abuse ,join bank statement and letter going to same address you both use thats enough with mental evaluation by a therapist ..that’s enough the rest evidences you will get it ..push harder Dnt let nobody kill your spirit!!! This is the way I can motivate you guys !! We will not suffer for whah we knew nothing about !!! So sad that those guys in vermont always want to watch male vawa filers cases in the cinema to see if they are truly abused 😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂😂

Not many !!! You should understand what am saying ,am not saying they don’t approve male but let’s be sincere most male gets tough scrutiny before they get approved ..do you think any male could get approved easily without no bank statement and not having kids for the spouse ..but women get approved easily with that !!! Men have to have more than what they ask for !! So get my point am not saying they Dnt approve men but you have to have more than what you gotta have cause they Dnt always wanna approve easily for men !!!

I get you... My initial package was huge! 4 years of marriage I bought everything for her. I had an interview that went no good. I actually now believe after everything that she did that on purpose... Does anybody have an experience like that?

Hey guys, thank you for your previous support and advice.
I recently got I360 "Card being Produced" status, so assuming this means approval I came up with a question.
I have I485 pending since September 2018 based on marriage (adjustment from K-1 Visa) which is currently at NBC.
Do I need to mail NBC requesting to change I485 basis to approved I360 or should I take no action and just wait for an interview ?
Will this change maybe happen automatically at NBC once they received approved I360 from VSC ?

Once I-360 is approved they will forward everything internally VSC to NBC to Local office.  My I-485 was also base on marriage, I was able to hold it, I have being able to renew EAD every since. And recently local office just RFE for medical. So everything was automatically linked, & forward.
