Hello Am new to this Beautiful site and I help your help my fellow vawa brothers and sisters.

Full story...... Been married to my wife for 5 years. I am under TPS who has a deportation under my name from a previous case from my yout. I left the country on advance parole and came back to the US using the advance parole.

I filled for adjustment of status and went to the interview with my wife. We killed the interview

But case was sent a denial letter stating that however my status was before I left the US is what my status will remain when I return to the US so long story short in there eyes I still illegally entered the country.

After that denial I decided to start over and do another application for my I- 130 in January 2020. Sometime in July 2020 me and my wife separated and in august I filed for I-360 for vawa.  I got a PF in November 2020. In march 2021 I got a update that my I-130 is scheduled for a interview but my I-360 status hasnt changed or updated from it showing that that USCIS has received my application.

Has anyone ever dealt with something like this before or experience something similar like this.

My question is what is that I-130 interview for?

Please give me some feedback cause am fearing the worse.

Timeline -

January 2020 - I-130

August 2020 - filed I-360

November 2020 - received PF

March 2021 - I-130 scheduled for a interview

I never file i-130 so I am not sure, but i believe the reason you have the interview is because you didn't notify uscis or withdraw the application. Maybe someone else can please chime in.

you said you filled another i-130 in Jan 2020. If that's the case then they scheduled an interview for that application. Since you guys are separated then you can go to interview by yourself and let the officer know to hold the i-485 since you have VAWA pending now.  If you do not know go then they will both reject the i-130 and i-485. in that scenario you have to refile i-485. or the other option is to write them to hold the i-485.

Hello and thanks for responding. The thing is I havent ever applied for I-485. Thats the issue I am having. I wanted to wait till I-360 got approved before filing I-485.

Hi, I am new here. Anyone who had Sept 2019 filing that got their approval?

Also, I have a daughter that is a derivative of my application we both filed I485 but she received an interview appointment already but our I360 has no approval yet. Should we attend or reschedule?

Thank you all!

The latest I saw was August, no September yet.

You should attend, bring your I360 receipt with you. The officer may choose to interview you then and when you VAWA gets approved you will just get GC in the mail - there was a case here like this (not with a kid, but just a person doing interview before approval). Or they may just put it on hold until approval. Either way I'd say attend.

VAWA was approved 11/2020

Depends on your state and city. Usually 2-24 months, but a year from approval on average.
