You can. File I-360 with USCIS. Get the receipt notice. File just the form I-485 with the lockbox in Irving, TX. Get the receipt notice for that. File I-485 packet with the court. Get proof that you filed (like a stamped cover page of the packet). Take the I-485 receipt and proof that you filed with court, and file I-765 with the Chicago lockbox.

Though some things to consider:

1. If you are subject to a removal order you will have to reopen the proceedings before you can file I-485 with the court. If this is an in absentia order you can get it done by proving that you never got the notice. If this is not an in absentia order then you will likely have to wait until I-360 is approved so you now have a significant change in circumstances to warrant a reopening.

2. If your removal proceedings are admin closed, it's a matter of cost benefit analysis. How desperate are you to get an EAD? If very - recalendar immediately and file I-485 with the court. If not - wait until I-360 is approved before you go around poking this bear. This way if the I-360 is denied you can regroup and retry. With open proceedings the judge might not take it well that you got denied once and you're refiling.

Yes... so no surety they you will get an EAD

I am not familiar with what your lawyer said so can’t say if this is correct or incorrect

If you want, you can reopen the case because it was approved by default and you didn’t know about it because notices were sent to an old address.

Hi VJ guys,

Please, what format can I use to request for PF? I need one for college. October 2020 i360.

What do you mean by “format”?

If you’re referring to how to request a PF, then it’s simple. Just type a letter with your A# and i360 receipt number and simply say you’re requesting an extension for the PF.
Attach a copy of the expired PF.

You dont need PF unless you are wanting to apply for state assistance or enroll in school.  I only received my PF 1 time and that 6 months after I applied.

Hello. I was thinking maybe somebody with IT skills could create an I-360 timeline spreadsheet so we could put dates of sending it, dates of RFEs, responding to it, dates of PF, approvals etc? I saw in other forums they have them and ppl found them very helpful..

Any one ?

Hey Jengaeco, receiving a PF shouldn’t make you sad at all..even though it doesn’t guarantee approval, not everyone gets it! The words you quoted are generic...also makes sense as you really shouldn’t expect a decision before the expiration. The good news is that you can be approved anytime regardless. I was approved back in 2019 two months after the PF was sent to me! The essence of the PF is mainly the benefits that victims of domestic violence can tap from while waiting for their cases to be adjudicated!😊👍

I’m a Sept 2018 filer. No update since last yr

Did you seek the help of your congressman? What did they say? It’s really taking time I must say even though there have been instances like that!🙁

I’ve asked AOC’s help, the same generic response. Last wk, I emailed Sen. Gillibrand no response yet. I-693 notice was last year but no updates as to when I’ll send the medicals via mail or bringing it with me during interview 😩. Can’t apply to another job due to this problem😡

Gillibrand is usually very responsive.. give her this week let’s see what happens. Stay strong for your mental/psychological health. I know it’s tough but the end is beautiful!😊👍
