I received  my 3rd PF today of 180 days, no RFE. Filing October 2019. This is a surprise FOR ME because i thought they won't issue a PF as there's a 204c decision on my i130 (that came last February 2021). Hope they just approve my case and i go fight my 204c on my i485.

your case is different as you are under removal proceedings... I am not sure you can get a work permit before your VAWA Is approved. 

You can. File I-360 with USCIS. Get the receipt notice. File just the form I-485 with the lockbox in Irving, TX. Get the receipt notice for that. File I-485 packet with the court. Get proof that you filed (like a stamped cover page of the packet). Take the I-485 receipt and proof that you filed with court, and file I-765 with the Chicago lockbox.

 

Though some things to consider:

1. If you are subject to a removal order you will have to reopen the proceedings before you can file I-485 with the court. If this is an in absentia order you can get it done by proving that you never got the notice. If this is not an in absentia order then you will likely have to wait until I-360 is approved so you now have a significant change in circumstances to warrant a reopening.

2. If your removal proceedings are admin closed, it's a matter of cost benefit analysis. How desperate are you to get an EAD? If very - recalendar immediately and file I-485 with the court. If not - wait until I-360 is approved before you go around poking this bear. This way if the I-360 is denied you can regroup and retry. With open proceedings the judge might not take it well that you got denied once and you're refiling.

Contradictions without citations only make you look dumb.

Hello! Received PF as well, and, as you know, I'm November 2018 too. I was in shocked but don't worry. They can make a decision anytime, we will not necessarily wait till the end of PF (some experiences here prove this!).

 

However I don't understand what is happening with September, October and November fillers. Looks like those three months has been extremely unlucky with cases speed.

I still didn’t receive my 3rd PF . I don’t know is it normal or not

Hey Jengaeco, receiving a PF shouldn’t make you sad at all..even though it doesn’t guarantee approval, not everyone gets it! The words you quoted are generic...also makes sense as you really shouldn’t expect a decision before the expiration. The good news is that you can be approved anytime regardless. I was approved back in 2019 two months after the PF was sent to me! The essence of the PF is mainly the benefits that victims of domestic violence can tap from while waiting for their cases to be adjudicated!😊👍

Hello everyone, I was checking stats of VAWA that USCIS publish for every quarter, I saw on average 3000-3500 cases are approved and 500-600 cases denied. I wonder why/what(reason) people receive rejection. Anyone following closely, will you please throw some light? What are common reason people receiving rejection. I saw rejection in VAWA is not common but but yet numbers are high. TIA<

At a glance, I would say if one is not qualified/ does not meet the requirements and if fraud is detected! 🤷🏻‍♀️

Ah make sense, If abuser spouse filed for annulment than divorce, will it consider as fraud? Or impact the VAWA case? My spouse filled Annulment even without telling me, I only got to know after it got approved. mails has been sent on wrong address.

One of the requirements of the petition is to have a qualifying relationship (marriage to a USC or LPR) an annulment voids that qualification! Most times you’ll be approved by Vermont but may not proceed past the i485 interview stage! You remain married until the annulment follows through! Most of the times abusers threaten but never go through all the hurdles..I’m not an attorney but I’ve heard it’s a lot that goes with it.🤷🏻‍♀️

Dissolution recognizes the marriage as valid..and is considered a “no fault “ proceeding to legally end a marriage. In a dissolution you guys will file a joint petition with the court requesting a judge review and approve it. So don’t worry as long as it’s not an annulment, the marriage is recognized as valid and besides your i360 is approved so there’s no consequences at all.😊👍

I believe those are the people who don’t know what documents they need to submit, that is why we are lucky to reach this far may god continue to bless this forum, Amen 🙏

Response on Oct

Jan 2020...2nd RFE  ...Evidence of good faith marriage

Response on April

May 2020.. filed 485, 765 and i-131

Sept...recieved combo EAD/ AP

NOV2020...I360  update ( a new card is produced)

April 2021..Intreview notice 

June 3rd 2021...I-485 Interview 

June 3rd 2021...A new card is produced (GC)
