Good you sent the counterclaim, chances are that he wouldn’t go through with it! It’s very typical of abusers..they think they own you and will get at you any way they can! Few people here have been threatened with annulment, but these abuser clowns hardly follow through!👍

My first ex-wife filled for divorced in my country and my brother was there to represent me. I got original copy of the divorce and I have submitted it in 2018 with the VAWA application. The word FINAL (ABSOLUTE) or DIVORCE DECREE was not written in the divorce but they wrote DISSOLVE at the end of the divorce and it was done in Customary Court and the same place we did our marriage back home. 

 

I have another divorce here in US with my abuser in  November 2018 after I sent VAWA application.  

 

What can I do now ?

 

Anyone with this kind of situation please advise.  Thanks 

 

 

 

My little advice to you is to resubmit your first wife’s  divorce documents with an affidavit of friends and families from back home, and if you do have friends and families here in the US who witnessed the divorce let them help you with affidavits as well and remember to let them notarize the affidavit. And no im just in a worry im so happy that you got that approval, and the only reason why i wanna have an answer is that im waiting for that approval for the past 6 years and i just want to be able to move and finally have a safe and normal life, also i have been offered a job for the city that will bring me security and stability and i don't wanna lose that opportunity. Also im also worried about my citation and how that may or may not affect my case.

I don't think they get mad! Unfortunately, if they delay cases there is no other way for us to move on with our lives. I personally don't understand why they delay cases for VAWA petitioners. A lot of us need to move to a different address or state or change jobs or surnames just to be safe from our exes. So I honestly believe that reaching out to your representative will NOT have any negative impact on your petition. I heard that 80-90% of what congresspeople do is immigration issues - so you are definitely not the only one they inquire about. I'm personally ready to sue - otherwise they will take years to make a decision.

I'm sure your life will be normal, and all this waiting and negative experience will be over very soon! May I ask about your citation?

Send a copy of your pending I-485, two passport photos, copies of the EADs you had before, birth certificate, copy of your passport, last I-94. I also included docs showing that I work, VAWA approval, copy of visa to enter the country, taxes - I always send them more to avoid RFE haha

Please I need answers anyone

I will like to go back to school for my LPN nursing program but I just heard that I can’t be a nurse unless I have a green card or a citizen, is this true? I came In with a B2 visitors visa and have a pending Vawa application , I also have my valid work permit. I will be paying for my school even though I have a PF. I’m in New Jersey

You need to prove the Divorce Absolute otherwise, they will deny your VAWA as you were not legally free to marry your 2nd wife.

I was only asked some YES/No questions, asked to show my passport, my birth certificate and my marriage license (the officer said I didn't send them which of course I did). Nothing else. the officer made a comment that my ex looks violent

fill out the application, 2 passport size pics and receipt of i-485. Did you pay for i-485? if yes then you do not have to pay the fee.

if not you might either want to pay to send the fee waiver.

c09 renewal.

 

hello everyone,

I was waiting for update since February after receiving medical notice. But I think its time to renew my EAD as it expires in July. Still praying for miracle for my I485 😟

 

I have few questions:

1. I know about competing the 1765 renewal form with attached pending i485 receipt, like  I did did last time.

do i need to submit approved i360 or any  other document?

2. is this renewal still free since my i 485 is still pending?

3. Where do I send the renewal too, Vermont, NBC or my local off(per congressman who inquired, they were advised in Vermont that they no longer have jurisdiction and it has been transferred to my local center (Newark)

 

Lastly: how is everyone holding up with the delays, I am almost going back in depression, I cant do anything without thinking about it. A lot of life plans but had to wait till GC.

Hi VJ members,

 

VAWA approved Green card on April this year

Married on May 2021.I am planning to file green card petition for my spouse.But spouse is F1 overstay(I-94 says as D/S-duration of status).When I had contacted attorney, attorney replied as "Since you are an LPR, if your Spouse is no longer in valid F-1 status or any other status, she will not qualify for adjustment of status.  You’ll have to do a petition, waiver, and consular processing." But as of my knowledge-- "overstaying his/her F-1 status, he never incurred any unlawful presence due to the “Duration of Status” clause implied on his F-1 entry, and the DHS, immigration judge, or the BIA never made any formal finding of a status violation on his part. My spouse does not have to subject to the unlawful presence bar and any of the inadmissibility statutes on INA § 212(a) " - no unlawful presence considered on this situation

 

and please help me with advice - if waiver and consular is required --please help me with timeframe
