Yes they will return the I-485 and give you the I360 receipt because that one is free

one more question, after submitting RFE response how long did it take to get your case approved?

I have not got my case approved.

I have recently responded to the RFE and waiting for their response. My lawyer says that usually it takes 1-2 months, but now might be way longer.

They will return any peition that was sent without payment.  If you mailed it all together, they will send the entire packet back.

will vawa adjudicator asks for divorce if anything ?? 

 

Can anyone please response to all my inquires will really  give me a lot of relief?. Thank you in advance. 

 

In addition to  Demise answer on q3 contact your congressperson for help to your missing letter and see  which one works for you best

I guess I am confused.  The letter for the 204C states why they made that determination.  What did it say was the reason for the marriage fraud?  Also, is the person who wrote the affidavit your first marriage?  When you received the letter with the decision, did you file an appeal?

3. Make a USCIS account and register the case there. That'll show you the whole case history. If it says that it was an RFE then write to VSC immediately so they'll resend it. If you moved make sure the request includes something along the lines of "My safe mailing address is X" or "I moved to X, this is my safe mailing address". Otherwise it was probably just a courtesy notice to bring something to an interview when it finally happens.

 

They might ask regarding your marital status but there's no requirement for you to be divorced so it's not a factor. Annulment if it actually happens looks bad but it depends on the circumstances. If you committed bigamy then yeah that's a kiss of death and I'm sorry but you're screwed, if your ex committed bigamy then you're fine, in most other circumstances it is outright impossible to annul a marriage short of you two getting hitched and then going your separate ways immediately after the ceremony. Regarding your response: if this was from the opposing lawyer if you got nothing that means that he probably doesn't have a case and the lawyer dropped it, if this was from the court check the docket information if there was a decision or some action done on this case.

Hi Demise, Thank you for your response. Yes, i did sent them inquiry about my work permit and they updated the status after three months which what is currently showing. 

the work permit was filled under C09. Also, i did not do anything my ex sent the grounds of marriage fraud for immigration in annulments and that i could not consumed during marriage. This was also from him and his lawyer before all along i also had a criminal case against him. He created fake minder profile of mine to show it to my ADA and finally when my ADA asked for abuse proof i gave it to her. Then my ex and his attorney was convinced to send him to anger management all this time they were beating around bushes to not agree. Since, then it has been a silence i am not sure did he actually drop the case or what: /

1. it simply means that USCIS is reviewing your application. Based on your timeline, it might take some descent time until they issue any type of decision. They should keep updating your PFs until they reach the decision on your case. My initial status stated something along the lines with “we have waived the fees..” and then I have got an RFE like 18,5 mo later.

 

2. unfortunately, there are a lot of delays in regard to EAD applications. Check the processing times, that will give you some estimate. Certain people are waiting for 5 mo, while the others take longer. I got mine approved after submitting an inquiry, but I am not sure if it was a coincidence, or whether they really taken that into consideration. Maybe the other forum members will be able to give you more info on what to do in your case.

just out of curiosity, what’s up with the annulment thing? I have never heard about anything like that.

 

 

Hi , my delays are abnormal my EAD is under c09 and still i did not receive it. Annulment is sent when an abusive spouse wants to destroy the other spouse immigration by voiding the marriage under fraud.

I am sorry to hear that.

 

Well, luckily annulment is extremely hard to prove. Unless he wants to throw himself under the bus too. I feel like your ex will ditch as soon as they realize that they cannot prove anything. As of now, all it proofs is that your ex is a psycho and is trying to continue the abuse by messing with your immigration. Hoping for the best 🙏🏻

All those are in line, have patience, good news are on the way for all of you, it is difficult time for all us but trust in god, we have wonderful family here helping us get through. I do not come online more often but i am in the happiness those who received their approval and by your side who are distressed while waiting, i can feel your pain. I am in the same boat, perhaps more in bad shape than normal. 

 

Update: Full packet November 28th 2020,

FP April 28th 2021,

May 28th 2021 New card being produced for I-765,

 

I-360 May 2020, 2RFES so far. So i am too early to hear back about my 360, too anxious. but optimistic, god bless you all,   

is the ead under c09 or c31 ?

i really pray and hope your words comes true, as soon as i hear he backed off i cannot wait to tell you all. trust me i have sleepless night since January. I have not been in peace due to this. I would have accepted everything he is doing if my purpose was just to get green card :(
