Officer did not ask for documents

Good morning,

I had an interview for AOS, and I prepared all documents as listed on the interview notice. 

 

Provided birth certificates, passports, lease, shared credit card, photos from vacations and day to day, etc.

 

BUT the officer never asked for the Affidavit of Support, income verification, or taxes. He ended the interview, kept copies of everything he asked for, then asked if we had questions. It was not approved on the spot, but officer shared it would take less than 120 days for a decision, and alluded to the fact that it would be approved.

 

In the moment I didn't think to ask about the affidavit of support but when we were reorganizing our documents, I noticed it was still in the binder. 

 

Can AOS from a K-1 be approved without the affidavit of support or will it lead to an RFE now?

You sent an affidavit of support when you first sent your application.

Correct. I sent Form I-314 with the original application. This time around I had Form I-864. But I was not asked to submit it.

Your application would've been rejected if you didn't send a 864, the whole package would've returned to you. And if not rejected, they would've sent a RFE before scheduling your interview. So I'm sure you sent it with the original package.

 

I-134 is for the embassy Interview, it has nothing to do with AOS.

 

If they made the mistake to accept and approve your application without a 864, then I'm sure some people will be fired soon...
