I want to request everyone's knowledge and suggestions with my situation. So my wife came from Japan last year on a K-1 Visa and we got married last year. We are still waiting on her Green Card interview appointment date. I am trying to file my tax but realize that I need my wife SSN, even if I file separately. She currently don't have a SSN. I read through few of tax related blog here on VisaJourney, and learned that she needs to get an ITIN and I should file an extension on my tax. Does anyone know where or what I need to do to request both federal and state tax extension? Also what would my wife need to do to get that ITIN? 

I would greatly appreciate any tips. Thank you for taking your time to read my post. Hope you are all safe and we are praying that things will get better this year :)

Here’s the instructions from the IRS on how to get an ITIN.

NOTE: the mailing way (Option 1) would require you mail her identity document (passport) to Austin, Tx along with the tax return and ITIN application. You would get the passport returned.

OPTION 3 would be best choice if you can get an appointment at an IRS TAXPAYER ASSISTANCE CENTER. They will certify a photocopy of her passport and transfer that, the tax return and ITIN application to Austin for you. it’s free.

OPTION 2 will likely have a cost because those are private business providing a service of what the IRS office does.

You can file an extension using any major tax software. If you haven't already chosen one, try picking one from the IRS Free File partners (if you qualify).

 

If I were in your situation I would definitely file for an extension rather than applying for an ITIN just yet. Worst case scenario, you could then apply for the ITIN before October 15, but that gives you 6 more months to hopefully have a better alternative.

Thank you so much everyone for all the great tips‼️ I am so grateful for all your comments🤩

 I do not owe any money to the IRS so I guess I will file for an extension and wait a little bit more before filing the ITIN. Hopefully the EAD gets approved soon😊

If you owe nothing or are owed a refund, just delay filing.  No consequence.
