My interview is a few days but I have found a possible mistake on my I-864

Hi Thank you for answering. I am a bit worried about what to do as my interview is on March 16th. My case has a primary sponsor and a joint sponsor (the joint sponsor is the father of the primary sponsor. Both joint sponsor and primary sponsor filed a I-864).

 

 

PETITIONER (PRIMARY SPONSOR) ADDRESS IS SHARED WITH:

- Petitioner Primary sponsor (No income college student)

- Mother (Parents not married - Tax filing status is Single, zero dependents claimed)

- Father Joint sponsor (Parents not married - Tax filing status is Single, zero dependents claimed)

- Sibling (No income college student)

 

 

 

Petitioner (son) and Joint sponsor (father) both share same address along with mother and 1 sibling. We believe the household size is incorrect on the I-864 it only shows:

 

Primary petitioner's I-864 household size - 2 (beneficiary and petitioner) 

 

Joint Sponsor's I-864 Household size- 2 (beneficiary and joint sponsor)

 

 

Can you please take a look at the above data and let me know if my household size is correct or incorrect on the I864? If so what should I do? 

 

Finally, do we also need to attach a I-864A for petitioner's father as well?

Everything is correct.

 

Petitioner's household is 2 = petitioner + immigrant

 

Joint Sponsor's household is 2 = JS + immigrant.  Mom is not counted since she is not married to JS.  Petitioner and sibling are not counted because they are not tax dependents and are not minors.

 

I-864a is not needed since JS is not married.

Ok I am relieved after reading this. So even if all of these individuals (mom, dad, sibling, and petitioner) live at the same residence, the household size is two?

Doesn't matter if they are all living together.  What matters is having a LEGAL obligation of support.

 

A person has a legal obligation to support a spouse.  A person does not have a legal obligation to support a partner they are not married to.

 

A person has a legal obligation to support a minor child.  A person does not have a legal obligation to support a grown son or daughter.

Yes, everything is correct.  Just living in the same house does not make one a household member in this immigration context.  No worries.

Facts are cheap...knowing how to use them is precious...

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
