My i751 date was a few days ago but still waiting for irs transcript

I was able to download IRS transcripts directly from IRS online. Are you waiting for the 2020 tax returns to be processed, perhaps so.

 

I would wait up to a month after the windows open to file the i751 to get your documents in order, so not much later than 60 days before your green card expires. Legally you can file your i751 application up to the date CGC expires and not be late.

 

Keep in mind that USCIS is very backlogged at the lockbox processing applications these days; it is taking up to two months for applicants to receive their receipt notices.

 

Be sure to ship the i751 application with a shipping method with tracking and a signature required just in case you need proof of delivery.

 

USCIS will credit your application on the date it arrived at USCIS lockbox not the date it was processed so your application will not be late unless they receive it after the expiration date on your green card.

 

If you have an i751 filed you will be okay even if you don’t get the NOA with an extension letter before your CGC expires which could happen due to the delay in lockbox processing time.

Okay thanks. So it won't be a problem if the I don't receive the receipt? Because I need to give it to my employer

As long as you file the i751 application you will be fine. Your LPR status does not laps, your proof of your continuing LPR status does laps.

 

There are legal limits on your employer on checking your current immgration status. 

 

If you are really required to have proof you can make an infopass appointment with USCIS to get an i551 stamp in your passport, but USCIS will require proof you need one and that you have filed your i751. Due to COVID USCIS is way backed up on all processing and limiting face to face interactions like getting the stamp and interview so it may be hard to get. 

 

Bottom line if you have a gap in proof of your LPR status you should let your employer know that your paperwork is being held up due to COVID but you remain in full legal permanent resident status.

Your current employer should NOT ask you for new documents or receipts: https://www.uscis.gov/i-9-central/complete-correct-form-i-9/completing-section-3-reverification-and-rehires

Employers should not reverify:

  • U.S. citizens and noncitizen nationals
  • Lawful permanent residents who presented a Form I-551, Permanent Resident or Alien Registration Receipt card for Section 2. This includes conditional residents.
  • List B documents

In the case of a new job your only options are to get a i551 stamp from USCIS office or wait until you get the receipt notice in the mail.

 

The primary thing is to file the i751 on time (before CGC expires) and the application is accepted and not returned. It will take weeks and weeks to learn whether the i751 was accepted and even longer to get an unsuccessful application returned to you. You will know when i751 is accepted when your check is cashed.

 

Main reasons i751 are not accepted:

Payment issues, some i751 have had credit card not accepted by the bank; I recommend a personal check or money order.

 

Filing too early (not an issue here)

 

Including the wrong payment amount (Check USCIS web site for current i751fee plus the biometric fee and how to make out the check) total of i751 fee plus biometric fee.

 

Sending i751 package to the wrong address. Check the USCIS web page for current addresses for the shipping method you are using.

 

Not using the current i751 version, please check the USCIS website to download the latest version of the i751 form.

 

Not signing the i751 form or not signing correctly, make sure the conditional green card holder signs as the petitioner and the USA spouse only signs as the spouse.

OP's GC expiration date isn't until June. If OP starts the new job before the expiration date then the new employer should NOT ask for the I-751 Receipt notice.

Thanks a lot for the detailed response. I have two questions. I live in a joint family unit. My father in law is the head of the house. He takes care of house bills and everything else. My husband only pays for my health insurance and we have car insurance together. We file taxes joinly as married. We had a bank account together but I closed it 7 months ago because we don't have any financial responsibilties together. The house is paid off but it's my inlawd house. So for financial records, I can provide the bank statements from the previous joint account, car insurance together, health insurance coverage, our 401ks beneficiary, and bank account beneficiairies. I am gonna get an affidavit from my father in law stating that we live with him in his house and he takes care of bills and groceries. What should be the text of the affidavit?

Also, I am gonna use fedex for mailing i751, but what address should I use on tbe affidavits from friends?

 

Because I used a sample online and that was standard address if you are mailing through usps. 

 

Is that okay because I am thinking to mail my package through fedex. 

 

Do I need to include those affidavits in the package or my friends have to mail them to uscis? In case, I include them in the pacakage, does it matter that the address of uscis on the affividavits is the one if you are mailing through usps and I am gonna mail via fedex?

Do not mail the affidavits alone, collect them and include them in your i751 package, if they are mailed to USCIS directly they will not make it into your file at USCIS (retain copies).  Affidavits we use in our application we used the same mailing address we sent the i751 to (but we never mailed them themself). 

 

Yes include previous joint account statements, car insurance together, health insurance coverage, our 401ks beneficiary, and bank account beneficiaries… yes to all of those along with W2s, 1099, even letters mailed to you and your spouse over the course of your marriage.

Be sure to write a cover letter that summarizes the evidence you have included in your i751 package and explains your living arrangement with your family.

 

@HRQX is correct, you would only get a i551 stamp if you really needed it due to a gap proof of your LPR status. If you apply soon you should be good. USCIS will only issue a stamp only if you really need one and can prove you need the stamp.
