Does it fall under AWA

I am preparing for AOS and encountered a problem... I've searched for the forum but could not find a similar care... wondering if I could get some advice from an expert. I am a foreigner and am married to an USC. he has an arrest record for video voyeurism but later the case was dropped and he was not convicted. The case is not involved in minors. Does it still fall under AWA (since video voyeurism is listed as one of the specific offenses)? Is he eligible to petition me?

He wasn't convicted
