I'm waiting for my N400 interview. My wife passed last year November. Do I still file my tax jointly or as single or qualifying widower? Thank you

I'm sorry to hear that. :(

This is probably a question for a tax professional, like an accountant or someone at a tax filing service, like H&R Block or something.

I’m so sorry to hear this, Limba :( Typically you can still file Married Filing Jointly for the year that your wife passes. For the two years after, you can use Qualifying Widower if you meet the criteria below; otherwise you file as single. Take care and good luck with your interview 🙏

  • You qualified for married filing jointly with your spouse for the year he or she died. (It doesn’t matter if you actually filed as married filing jointly.)
  • You didn’t remarry before the close of the tax year in which your spouse died.
  • You have a child, stepchild, or adopted child you claim as your dependent. This doesn’t apply to a foster child.
  • You paid more than half the cost of maintaining your home. This must be the main home of your dependent child for the entire year, except for temporary absences.

Well tomorrow is the big day, assuming nothing out of the ordinary happens! Interview time! Hoping for a same day oath. One of the people on this site has their oath tomorrow at the same field office. Who knows? Maybe they'll let me.

Orlando field office. :)

June 19th Filer here.

Filed online under the 3 year green card rule married to US spouse. I forgot about the 90 day window to apply early and applied after my GC anniversary date (June 2).

I got an instant receipt but no mention of bio-metric re-use, perhaps it's been so long since my last one (AOS)?

Just had my interview today, and passed!

They went straight to the testing components (I didn't get 10 questions, maybe they stop when there are enough correct answers) and I answered questions for the oath. That said I am waiting for an oath ceremony to be scheduled. No same day oath here in Dallas.
