Timeline

Hello there!

my 2 years Green Card expired and my 18 months extension as well. Case status is telling me that my case is ready for interview since 22 April 2020. I understand that we have Covid situation here but I need  your advice, guys.

I'm currently back in Czech Republic and not sure if I can come back to USA. With expired Green Card and ended extension?! Logically I could but I have no proof really only I797 Notice of Action with that expired extension.

Why didn't you board a flight before everything expired?

 

I think you can attempt to get a boarding foil or something like that. @JFH might be the expert on this

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

moved from "IR-1/CR-1 spouse visa process and procedures'" to "working and travelling" - question relates to an LPR trying to return to the US with an expired GC.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

7 months? And you didn't notice it was expiring? And neither did you put in a request for a new extension? You really need to be onto of important stuff like this.

 

Not sure if Czech was on lockdown but even if it was, you could have gone round it by quarantining for 14 days in another country. Many people got it using that method. 

 

Anyway, I guess you'll have to attempt a boarding foil. I don't know the procedure. The other members will chime in on how to obtain one. However, it has been noted that it all depends on circumstances. So you may have to answer a few questions to the relevant authority before you get/ not get one. 

 

What was the reason for your overstayed, if I may ask. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Boarding foil may be possible. Airlines will not let you board with expired GC and expired extension letter. Why did you leave the country during COVID and why have you not been able to return before the letter expired?

Boarding foil is usually a easy process,  the bad news is it's going to cost you about 500 dollars. It's a pretty simple form you fill out and file at your local US embassy. You may be able to do it via mail even with the restrictions.

 

As a side note, the foil is a one time use, and it only allows you to present yourself for entry into the US, it doesn't guarantee it. But I don't see any issues as you were not out of the US for more than a year.

 

Another option, you can travel to a neighboring country if you want, if you can enter mexico or Canada, then cross via land entry. You could avoid having to pay for a boarding foil if you have a valid passport and get visa free entry into Mexico or Canada. You will still face some questions probably, but might save the 500 for a foil.

Your problem is going to be getting on a plane.  No airlines is going to allow you to board with an expired extension letter.  Not returning to the US prior to that date was a big mistake.  You might be able to get a boarding foil at the US embassy/consulate.  I know of no other solutions. By the way, you could face some close scrutiny when you arrive in the US.  Good Luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
