Expedite - NVC or Embassy request?

Hi VJ friends,

 

I recently got denied for my expedite request for the interview. The request was sent to NVC. A lawyer is suggesting I submit the expedite to the embassy directly. Is this a good idea or waste of time/money?

My understanding based on reading other threads in this forum is that NVC forwards the expedite request to the appropriate Embassy/Consulate, who at this point would have already reviewed (and denied) it themselves, and then notified NVC of that, who then notified you. Hopefully others can confirm.

 

When you say waste of money are you referring to paying the lawyer to submit another request to the embassy? If so, I would save your money there. However, if you were to collect more evidence in order to make a stronger case and then resubmit the request yourself (to NVC once again), I have seen reports here of expedites being approved after more than one attempt. Whether or not that is worth your time depends on if you think your reason for expediting is compelling enough to continue to pursue (keeping in mind that there are no doubt many others out there trying to expedite the process along with you).

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

This is my exact experience. My initial NVC request was sent to the embassy and was denied. I gathered more information and reapplied through the NVC again and was accepted by the embassy.  Maybe others exist who have experience applying directly through the embassy can imform you of their experience.  Of course, there is never any harm in trying to apply directly to the embassy if your lawyer is aware of how that process works.

17 July 2020 - I-130 Approval Notice (Nebraska Service Center)
15 Sept 2020* - Submitted documents to NVC
01 Oct 2020 -  Case FE Review note: Request to submit marriage termination document.
01 Oct 2020 -  Spouse divorce papers submitted
01 Oct 2020 - DOCUMENTARILY QUALIFIED

 

Notes:
* Foreign police clearance lost by Fedex - delayed submission to NVC by 6 weeks.
