Situation with I-130 and I-485

My wife submitted and I 130 petition that was accepted on November last year. I didn't submit a I-485 along with it. When I submitted the I-485 separately, it got rejected twice. Today I was able to get a hold of an immigration officer who said that my I 130 approval went to NVC and that's why it's not showing up on their system. I have to submit an I824 to retrieve that and then the rest of the process will follow. Given that I824 will take a long time to process and have a similar filing fee, is it okay if I just submit a brand new I-130 application along with I-485?

Two options:

1. You can submit a brand new i-130.
2. However, I would suggest that if you have the receipt for the old one, put it on top of everything on your package. It was the "key." You cannot open a door without one. 

I would go with 2 and save $$ 500+

The two i-485s that got rejected had the approval notice attached, and it still didn't do the trick. They just can't find my approval notice. Besides, I-824 will take $465 as well, so might as well submit a new I-130 which will cost additional $70.

Then in your case, a band new I-130 will be good. Do not waste time trying to retrieve

Thanks, I just wanted to make sure a brand new I-130 will not be an issue

There is a place there that asks if "someone has ever filed a petition blaaa blaa blaa" You will have to say yes and then explain. Maybe say you filed but forgot to follow-up immediately with I-485
