Hello everyone, 

 

So, as the title says, It's currently tax season. I filed my AOS last November and I have only received my NOA-1 last December 9. Says that they have received my I-485, I-131 and I-765 forms and gave my receipt numbers. Do i have to apply for ITIN? ITIN form is asking for my visa number which is K1 and it was already expired last November I'm worried and it'll just come back gives us more paperwork. I don't know what to do and I feel bad for my husband. Any input and help would be really appreciated.

To file a joint return, you must have a SSN or ITIN......no exceptions.  Either apply for the ITIN or file separately now, then amend later.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I filed for an ITIN for my spouse last year and I don't think it matters if it is expires.

Also per the instructions, there are other forms of identification that you can send.

 

If you are concerned about the stimulus, file for an extension but pay what is due one time.

You need an ITIN. It doesn’t matter if your K1 is expired. People get ITINs who have never entered the US or who are undocumented immigrants who entered without a visa. 
 

The process is prepare the joint tax return leaving your SSN blank. Print it to paper.

Fill out the W-7 ITIN application.

Mail both with your required ID (passport) to the address in Austin , TX. 

 

If you don’t want to mail off your passport, then get a copy of it certified at an IRS Taxpayer Assistance Center. They will submit the other things for you. Make an appointment if you find an office currently open.
