I left the USA on February 8 for work reasons and I left with the BIOMETRICS PROCESSING STAMP document (01/16/2020), but without an updated i 751 document, or one that notifies that the request for REMOVAL OF CONDITIONS IS IN PROGRESS. Who should I contact for reentry to the USA or what procedures should I follow to receive instructions to return to the USA?

Is your green card officially expired now? If yes, then I am sorry to tell you bad news but you will not be allowed on a return flight if you do not have the official I-751 extension letter. What is this "biometrics processing stamp document"? Is it the letter saying your old biometrics is being used? That letter is merely a notification. It has no legal benefits of any kind.

If your Green Card has expired, you will need the ORIGINAL extension letter and your plastic card to even board a flight.  I suggest you contact the nearest US embassy/consulate and attempt to get a boarding foil.  If you can get to the US border, you will, likely, be allowed into the country.  The only other option I can think of is to contact USCIS and wait for them to re-issue an extension letter.  That could take a long, long time.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Start planning you flight itinerary to Juarez, Mexico.  And then walk into El Paso, TX.  It’s the only practical alternative I see.

I submitted my documents for the I-131 on March 26th, since I lost the the I-751, anyone knows how fast do you get a response/approval for the I-131?

 

I have not any news of information about any update. Best,

Thanks for the reply. In context: I made a trip abroad but I lost the i751 document where it said that my Green Card (expired) was in process (I already did the biometrics), and since I have not been able to re-enter the States they asked me for the i131 to obtain a document reentry. During the trip I was scheduled an appointment given the change of jurisdiction of my process and to attend an appointment for the new Green Card (I suppose).

Seems weird.

 

Did you contact the US Embassy/Consulate for help?

Definitely; what they asked me was to quickly send the form in question in the city where I am now (overseas), and to the USCIS offices. As I am not in the States, where I live and I have my company. In spite of it was difficult for me to compile all the information but I managed to do it and send it a week ago.

Agree with Mike E, you'll probably be let in via land border assuming Mexico doesn't have any Covid restrictions. Crossing via pre-clearance somewhere like Aruba or the Bahamas might work as well, but I'm not sure if the airline would let you into the US customs area without your documents. You could also try getting an entry document but that's $600 and will take time, so if you want to go that route, contact the embassy ASAP. Calling USCIS is always an option but it's a hot flaming mess right now and incredibly difficult to get ahold of anyone beyond T1 support - could be worth one call, however. Good luck! 

 

Edit: one final idea - did you happen to scan the I-751 extension? We took a super high quality scan of the document when we received it and keep it encrypted in the cloud so we can access it anywhere. If you can reprint it, maybe the airline would be willing to overlook that it's a copy (or wouldn't even realize/know that you need the original). At the very least a copy should make things easier if you reach the US border or need to go to the embassy.

The embassy in Bogota said to do that? The correct form can only be filed in person at the embassy: https://www.uscis.gov/i-131a

Where to File

You must file Form I-131A in person at a USCIS international field office or with a Consular Section at a U.S. Embassy or Consulate. Before appearing in person, you must submit the filing fee through the online payment system on our website (see the Filing Fee section below). When you appear in person to file Form I-131A, you must bring evidence that you paid the fee, such as a copy of the payment confirmation page or a copy of the email payment receipt notice.

 

Before submitting your filing fee, please contact the nearest USCIS international field office or Consular Section at a U.S. Embassy or Consulate or visit its website to verify that they can process the Form I-131A, and carefully read the form instructions.
