Hi guys. I haven't posted nearly a year as our case got stuck for a year due to covid and it is only now that things are moving forward for us. Before I get to my question, I will give a brief background to our situation. I petitioned (CR1) for my spouse who lives overseas back on December 15, 2018 & his interview was going to take place on March 14, 2020, but because of the pandemic & because he had to travel to the neighboring country to attend his interview (his nativ country only processes nonimmigrant visas), the borders closed just a few days prior to his interview and he didn't get a chance to attend it. The US Embassy rescheduled him several times throughout the year, but the border was closed the whole year, so he didn't get a chance to travel from last March until this upcoming March. I would appreciate if you guys can answer a few questions before our interview please because it's been a tough ride for us to be stuck like this for the whole year and I just want to get some updates and get info at the last minute. 

 

1) Now that he has a new interview date and the border reopened & we have a new president, I wanted to know what happened to that DS-5540 (public charge questionnaire) requirement because I remember that it became mandatory in 2020, then mid-year, I think it was canceled (or not?), then people said it should be still filled out & assets must be shown for interviews, but then I also heard that DS-5540 only pertains to when the petition was filed? I am really confused what the requirement is for that new DS-5540 form now as ne are getting ready for this long awaited interview of my husband. Have you guys been asked for DS-5540 at the consulates/embassies? I can't find info about this online but we need to be prepared. I really hope that Biden has revoked this by now.

 

2) Since we have a new president now, do you guys have info as to whether the interview difficulty has eased a bit this year because I remember how Trump gave orders to the consulate/embassy staff to be stricter whom they would approve even if the spouse met the minimum requirement, which wasn't as strict before Trump. Has the situation changed for the better in this regard? For example, last year there was talk everythwere that even if you meet the minimum for sponsoring, your spouse would most likely be denied the spousal visa as you are supposed to show much higer number than the minimum.
