I noticed that the example letter is from/signed by the US citizen spouse. I am assuming this is because it is a joint petition as opposed to the AOS.

Has everyone pretty much followed this example and sent the I-751 with a smilar cover letter signed by the USC spouse? I guess it would solidify the petition since it would further "document" the relationship, but at the same time it is the non-USC that is asking for the removal of conditions on their green card.

Hi Dave,

I didn't even think about that. I signed the letter because I put together our packet and wrote the letter. I think I put both our names on it, but mine was the only "ink" signer. We haven't had any trouble so far.

Actually, if you file the I-751 as a joint petition, then it is both the USC and the non-USC spouse petitioning for the removal of the conditions. Hence, a joint petition. We put the letter on a letterhead that has both our names on it and we both signed the letter. Which makes sense since we also both signed the petition. I don't think it matters an aweful lot, though.

A cover letter is not required (but I would recommend it for a better organized application). Who signs it is not important; no signature is fine, too. The I-751 form must be signed by both for a joint application, and I guess that is what the USCIS is looking for. Our cover letter was only signed by me, the non-US spouse, but first checked for errors by my wife, too.
