Hello all,

I am in the process of filing AOS for my now wife. She got here on K1.

I just want to ask the forum the required forms for the AOS. From the post below from VJ. I assume these are required. The reason i asked is it is kinda confusing requiring i944 and i-864 at the same time?

1. I-485
2. I-944
3. I-864
4. I-765 (optional)
5. I-131 (optional)
6. G-1145 (optional)

Both are needed.

I-864 is filled-out by the US citizen, and the rest of the forms by the immigrant. In general, send the following three packets (*note that I-765 and I-131 packets are optional, but highly recommended) in the same envelope to the Chicago Lockbox:

  • I-485 with I-864 and supporting documents, I-944 and supporting documents, electronic I-94 copy, filing fees, etc.;
  • I-765 with electronic I-94 copy, etc.; and
  • I-131 with electronic I-94 copy, etc.

You'll separate each packet with rubber bands or fasteners: https://www.uscis.gov/forms/forms-information/form-filing-tips

On the I-485 packet, I-485 payment method (check, money order, or Form G-1450) must be the very first item of this packet.

Thank you so much. We are kinda overwhelmed with how much paperwork this is. Quick question, comparing this with i129f process, which one do you have think more difficult?

This one is way more difficult especially the I-944 .

I just looked through it and i am dreading on it. My wife only has Vietnamese high school diploma and transcript , do i need to have be evaluated? Or just have it translated is enough?

Just translate is enough I think.  I translated both my wife high school and college diploma by myself. You can look up Vietnamese translation format for high school diploma if u wanna do it yourself and include something like this.

Hello all,

I think i have gather most of everything that i need for AOS package. However, i am just trying to make sure i am assembling them correct.

First question is where do i send the package to?

Per this website: https://www.uscis.gov/forms/all-forms/direct-filing-addresses-for-form-i-485-application-to-register-permanent-residence-or-adjust-status,  if i am using the USPS, i am supposed to use the following address:

USCIS
P.O. Box 805887
Chicago, IL 60680-4120

Is this correct?

Another question i have is how to assemble the package

I am filing i-485, i864, i944, and i-765. We decided to opt out the i-131 since we dont see we will be traveling anytime soon.

I am thinking of using 2 big envelops:

First one will contain i-485, i-864 and i-944 along with their supporting document

Second will contain the i-765 with their supporting document ( Not sure if there is any required documents).

I see people putting each form, along with its supporting document in one enveloped. I am not sure if this is correct is i-485 requires i-864 and i-944 to go along with it. Am i wrong?

Lastly, after i have the envelopes, do i put them in one single envelope and ship it via USPS and it will be in their own shipping envelope/container.

Sorry if i confused you, evelope inception here.

Instead of envelopes you can separate them with rubber bands or fasteners: https://www.uscis.gov/forms/forms-information/form-filing-tips

I-765 and I-131 are free to file and approved AP is good to have in case unexpected emergency travel comes up. https://www.uscis.gov/sites/default/files/document/forms/i-485instr-pc.pdf

Filing Form I-485 with Forms I-765 and I-131
If you properly file Form I-485 and pay the required fees, you may file Form I-765 and Form I-131 without paying additional fees. You may file these forms together, or if you choose to file Form I-765 or Form I-131 separately, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed and paid for Form I-485.

For I-131 dates not needed. Put "TBD" for the Date of the trip; and "As needed" for the purpose of the trips.

You might need to handwrite "TBD" in that field if the PDF editor doesn't let you.

And select the box for Multiple trips.

Thank you so much, regarding filing them correctly, i am nervous as i check them 2 times a day and i keep telling myself this is correct. I am just afraid it might get rejected.

So for the AOS pacakge, i-485, i864, i944, i-765 and i-131 with the Fee of 1225 dollars correct?

Do i need to put on the check that i am paying for Adjustment of Status and Biometric fee?

@HRQX I'm laughing about the 'promptly approve my request...' knowing how backlogged everything is but besides that these are great examples for cover letters.

I have another question regarding i-693. I got the wife's medical examination back like a month ago and i am planning to send out the AOS package 2 weeks before  60days expire. Do you think i will be able to avoid redoing medical exam for my wife?

The 60 days rule i am kinda confused, is it 60 days i have to send the package out, and that does not include the USCIS's time to start checking my package.

Thank you.

It can't be signed by the Civil Surgeon more than 60 days before it's "filed." USCIS will consider it filed on the day it arrives at the Chicago Lockbox. See 8 C.F.R. 103.2(a)(7)(i): "USCIS will consider a benefit request received and will record the receipt date as of the actual date of receipt at the location designated for filing such benefit request whether electronically or in paper format."

Thank you, i was so worried since i am rushing to make it before 60 days. I probably can delay a week to be a bit more thorough and i will have it expedited to the chicago lock boz
