Processing times went sky high for EAD

Timeline

Just a day before my daughters would be outside normal processing times it was to 3.5 Months to 11.5 Months  I don't know how it can go from May 30th to March 27th.. It seems this always happens right with they get to June 1st.  I wonder if I apply for them to have advance parole would that speed up the EAD as they usually do combo cards. They both had the biometrics back in August and my wife got her EAD in October. This is frustrating as I want to file my taxes soon.

My wife came to the US on an F1 visa about 10 years ago.

Timeline

EAD/AP has been 6 to 8 months for a long time, I have seen people get them sooner, some later.

 

EAD and AP are applied for at the same time. If for some reason you did not you can apply later but will come later.

Timeline

I submitted my I-765 with my AOS package 09/28/20. I then applied for my AP 01/05/21. Somehow my AP was approved 02/09/21, still waiting for my EAD. I guess it doesn’t hurt to try, though!

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

Well that throws out my hopes that it would speed it up. I just can't understand why they weren't approved the same time as my wife's and it has been over 4 months since then.

My wife came to the US on an F1 visa about 10 years ago.

Yes my wife got her EAD in about 4 months then later we applied for advance parole for her it that took about 2 months. 

My wife came to the US on an F1 visa about 10 years ago.

Looks like they selected the applicable boxes on Form I-765 for SSN issuance. I.e. with EAD the child is eligible for SSN. For the child tax credit the child needs SSN: https://www.irs.gov/faqs/childcare-credit-other-credits/child-tax-credit

 

Answer:

No, you may not claim the child tax credit for a child with an ITIN. The child must have an SSN to be a qualifying child eligible for the child tax credit (CTC) or the additional child tax credit (ACTC).

Yea I don't really need the EAD for taxes just the SSN that comes along with it. If I file with the SSN we get back $5,000 more in stimulus money and child tax credits. That's too much money to leave on the table by filing with their ITIN.

I'm in the same boat.  I'm relying on the tax extension til October 15th to see me through the wait.  We only applied mid December.

Try for an extension, my husband is.... we filed for EAD April last year and I still haven’t got it, I’ll likely get my GC first

I need their SSN's which I can't get without the EAD. So if I file now I will lose out on $5,000 in stimulus and child tax credits.

The timeline is confusing because this site doesn't let me update it and I didn't want to create a new account. So it mixes my previous marriage with my current one. I was married 8 year previously so way back then is when I created this account. With my current wife we have been married 1 year. The SSN's I need are with my step-daughters (now adopted) who are from my current wife.

Legally adopted? If so, they'll automatically become US citizens when the I-485 applications are approved: https://travel.state.gov/content/travel/en/Intercountry-Adoption/adopt_ref/adoption-FAQs/child-citizenship-act-of-2000.html

you will need to present the following when applying for your child's U.S. passport:

  • Proof of the child’s relationship to the U.S. citizen parent. For an adopted child, you must submit a certified copy of the final adoption decree (and a translation if the decree is not in English);
  • Proof the child is admitted as a lawful permanent resident, such as the child’s foreign passport with a I-551 stamp, or the child's permanent resident card (green card);

  • Evidence the child is residing in the United States in the legal and physical custody of the U.S. citizen parent;
