Hi everyone,

My mum is currently living in the Philippines and I plan to petition her. I was just wondering tho, does the I-130 come with a Greencard? If not, do we just file the I-485 together with the I-130?

Thanks so much

No, the way it works is you file an i130, she gets an interview, if successful she gets an immigrant visa, when she enters the US using that immigrant visa she will get a green card.

I485 is only for people living in the US, you say she is in the Philippines.

Greetings!

1. You must be a US citizen first. Apply using Form I-130 along with all the documents that are needed.

2. Once approved, the case will be sent to NVC and because it an immediate relative it will be fast.

3. You will then receive instructions from NVC to pay bills and must submit scanned documents from both sides.

4. Once all documents are accepted and approved, (documentarily qualified) She wil then be queued for her interview.

5. You and your mom will have to prepare all original documents needed for her interview. while waiting for her interview appointment.

6. She must schedule medical then attend to her interview.

7. She will come in the USA as legal permanent resident, wherein her green card good for 10 years will be mailed 12 to 24 days upon arrival and if the question was checked on DS-260(if there is no changes or delays)

8. Her SSS card will also be mailed if you checked the part on DS-260 form.

9. Then your mom  may renew her green card 3 monts before 10 years time.

I-90 for renewal can be filed up to 6 months before the expiration: https://www.uscis.gov/i-90 "My card will expire within six months or has already expired."

Hi again,

She has the option to either apply citizenship (based upon 5 years )or renew her green card 6 months before green card expired. Good luck! It come very fast for my mom. Six months including interview. Green card and SS card was mailed not even 2 weeks after her arrival. So advise your mom to just prepare documents needed esp her passport as appointment take sometime due to pandemic. Best of luck, NG
