Are you saying I don't need a joint sponsor? I don't see why she should meet the income requirements for a household of 2, when she was single last year and her household was 1 🤔🤔🤔

I am using Simple Citizens and I think they are messed up. They are no help at all. I wasted my money to use them. 

 

Looks like Simple Citizens do not know how to read properly.   Per Form I-864 instruction:

 

Quote

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months.

 

The instructions show examples of how to prove current income.  One is a letter from the employer.  Another is 6 months of pay stubs.  Notice the "may also" phrase.  The 6 months of pay stubs are not required if you have other evidence.

For this year she will meet the requirement due to her current job. Her employer already sent us a letter and we have pay stubs. What I don't understand is why she doesn't qualify due to last year's income instead of her income potential for this year. Last year she was single with a household of only 1 and she made around $14000. This year she's married with a new job and her potential income will be more than what USCIS is asking for. Now, Simple Citizens still claim I need a joint sponsor and I don't understand why. So that's my question.i am confused on whether she meets the requirements or not.

There are 2 requirements

 

File taxes

Have sufficient income well you can also use savings

 

Now if you are sponsoring someone why would historical income be of interest? They want to know that you have money coming in now which will hopefully continue to meet your sponsorship obligations.

 

Have a read, you are an International Student, it is pretty clear.

I don´t have any specific information to give you but just some advice:

 

Do not blindly rely on lawyers. Every single time I log into this website I hear horror stories about people who got information from lawyers and now their case is delayed. Take it upon yourself to read the instructions and to REALLY understand what is being asked of you. There will be new terminology and you will just need to learn the process. This will be a long and bumpy road and you might as well be in the driver´s seat of your own car.

 

You may still use a lawyer, if you feel that you need to. But the advice that you get here will be MUCH more accurate.

 

However, there are MANY questions posted daily and people who give the advice do it for free and out of their own good soul. People don´t love answering easy questions that can be found by simply reading the instructions. But most here will really do their best to help a fellow immigrant when they see you´ve done your due diligence and are still struggling.

 

Good luck! You seem to already be ahead of the game, because you found this website.

To OP, unless your case is extremely complicated (in which case you’d need an immigration lawyer, not one of these companies) I’d recommend you do everything yourself... they often give out wrong or misleading information as you’ve just discovered and are generally only interested in taking your money... no one has more interest in your case than you, they’re making you do all the leg work already so why pay them to double handle your files and make the process longer since you now have to send everything via them? 
 

this site has so much help... everyone here will happily give you advice if you just ask a question..

2) His main boss quit, so he can't get a verification letter from the company. 

 

Am I better off looking for another sponsor or is there something I can do to still use my father in-law as my join sponsor?

Sounds like a straight forward AOS case to me.. just need to prove wife’s CURRENT income is 125% above the poverty line.

 

@aaron2020, @Lucky Cat, @Boiler and @Jorgedig have given you some great advise, please use it, they’re some of the best and more active members here..

 

As for the company your going through, my advise is save your money, do it yourself, no one has greater interest in your case than you, companies like this usually just create confusion, make errors and make the process longer.. I used a similar company initially, called rapid visa wasted $1300 on them, money that could of been put toward immigration fee’s etc, the process is expensive enough without needlessly wasting cash.. I’m not saying you have to dump them, but they’re really not doing a whole lot for you, save your money.

Thank you for your input. Yes, I am done with everything except for the sponsor thing. I am thinking I would just find myself a joint sponsor to be sure about what I am doing. I have been a student in the US for over 2 years now. I have not used any government benefits or broken any rules at all. My case is straightforward and I am intelligent enough to do things on my own lol. I mean, I came to the US and I did all the visa work by myself without any help. All I did was read information online and I got my visa. Even though it's hard to get a visa from my country. This time I would say laziness and fear was my problem. I was filling the files on my own before I decided to go with a company. I wanted to go with Rapidvisa, but I decided to try simplecitizen because they were cheaper. They got recommended by my brother in-law who already got his green card. 

 

Secondly, I am a computer science student and I have a lot of programming projects I am currently doing. I felt using a company would make it faster and easier for me. I could have done things the old fashioned way, that's reading the information here and doing things myself.

 

I understand and appreciate all you said. You are right. I have always been skeptical about agents and online platforms claiming to help you make things easy. The best way is to read and do things on your own. Your knowledge will increase and it brings satisfaction to know that you are capable.
