My partner and I are newly married and we are about to file for aos.my husband has a kid from his previous relationship but he doesn’t claim him as a dependent when filing for tax.my question is does that mean we a household of 2 or 3? We are new to this whole process

Read carefully the form instructions.  Page 7, Part 5, Item #4.

He must count his minor child even if he does not have custody or claims the child on his tax return.  He has a legal responsibility to care for his child, so he must count his child in his household.
