Hello, I’m on H1B status in States and My parents has F4 file ( filed by mom’s sister ), Can someone help with CSPA Calculations and Is there any other way to be immigrant when my parents arrive in states. Here is details for our application,

 

My Birth: 02/07/1994

Priority Date: 03/23/2005

Approved Date: 08/20/2009

DS 260 Filed: Aug 2019


I paid all fees for me along with my parents. However, When I open the portal now, I cannot see my name after couple of months.

We’re waiting for interview letter currently.

 

As per calculation, It looks like I’m already aged out but is there any other way to get eligible for GC? Any help would be really appreciated.

Hi,

 

Sorry, but you aged out under CSPA.  

Your parent's PD became current on 12/01/2019.  That makes your CSPA age to be 21 years, 4 months, and 26 days.

There is no way for you to get a green card as a derivative of the petition filed for your mom.


Once your parents become green card holders, they can file for you in the F2b category, LPR petitioning unmarried son/daughter over age 21.  The current wait is about 7 years.  You must stay unmarried the entire time until you get your green card.  Marriage will automatically revoke the petition.

Agree with your calculations.

 

H1b normally look to employer sponsorship.
