In this specific case (AOS via marriage to a US Citizen) the overstay is completely overlooked.

Thank you!

Do you have any experience with the form I-994? I have a few questions about this

For my fiance as he hasn't lived or worked in the US, he doesn't have credit score, tax returns etc here. In the form do we leave it blank or give this information from his country?

This was on the official instructions

"At the time of interview on your application, an officer may request the tax return transcripts for the current tax year. Submit any tax transcripts for any income taxes that you or your household members filed with any foreign government if you or your household members were residing outside of the United States during any time within the most recent tax year and you were not required to file a federal individual income tax return with the United States government."

It says if you have lived outside the states with your household members but we never lived together

For tax information give the stuff from abroad (numbers and tax forms (translated)). For US credit report either he can get a letter from equifax that he doesn't have a US Credit score, or submit a signed affidavit that he never had an SSN or ITIN and therefore doesn't have a US Credit history.

Thank you, we prepared a sworn statement.

In the form, it also asks for receiving any form of public benefit. I assume it's in the foreign country. My fiance received monthly payments from the government after losing his job to Covid. Would we need to document this in the form?

No. It's asking about US federal, state, local, etc. benefits: https://www.uscis.gov/policy-manual/volume-8-part-g-chapter-10 "Public Benefits Considered" section

Also see "Public Benefits Not Considered" section

Thank you so much, we read the instructions multiple times and it states the name of US benefits but it does not explicitly say ONLY US BENEFITS.

How about for educated related loans? Shall we put both ours or just mine the US citizen
