I've wonder,  if someone brings a child, don't they need permission from the other parent, if one parent is immigrating to the US?

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Have you considered filing I-130 for her and her son for consular processing so they can both immigrate at the same time?  Since she has a B-2 visa, she can come and visit you without having a long separation with her son.  

 

This is true it will be difficult for him. But hes also old enough to understand which we already talked to him about

The laws in my wife country is, the mother has rights to the child and if she marry's permission is not needed from both parents, only the mother to bring the child to live in the US

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

We had some issues with getting some of our documentation approved initially because of the translations.  Sweden recognizes both English and Swedish and we mistakenly sent a couple of the documents only in English.  This was not accepted.  The documents were required to be in the native language of the country they were from and the translated English version and then you need the Certification by Translator document.  My husband was able to sign the certification document since he is fluent in both languages.  The best of luck!
