Hi Everyone, 

 

Ugh I am overwhelmed looking at all the AOS paperwork- like I am sure we all are... 

 

My Fiance and I are getting married in April and I was just looking over all the paper work ahead of time and I am very glad that I did.. however I do have a few questions 

 

Our situation, I just graduated college May 2020 and Fiance Graduated August 2020- I found a job soon after graduation and I make $40k but since I only started half way in the year my 2020 tax return shows $25k which is above the limit but not by much... My Fiance started his full-time job in May as well and makes $40k also butt he also quit his job last month since he is moving to the US - and has never had to file taxes before because he's only ever worked internships and his parents own a 2nd apartment that my fiance was living in rent free when he was studying..

 

I guess where my worries come into play - They ask for my fiances tax returns but he obvs doesnt have any... and then also credit score which he also doesnt have but he also doesnt have any bills in his name since the apartment and everything attached to it was in his parents name.. 

 

Is this going to cause problems with the AOS paperwork. Anyone heard of someone in the same predicament? Also when the form of self-sufficiency asks for debts are they looking for US or foreign or either. He does have school loans abroad. Will his medical insurance abroad work for the form as well or should I wait to file the AOS until I can add him to my health benefits plan? And one last question- How will me changing my name after marriage affect the documents and by that I mean when I submit birth certificate or passport would they still be considered valid or do I have to wait until they have issued me new ones?

they ask for it if available, that is, if you actually filed any. if your fiance didn't file anything then you have nothing to provide.

most people coming to the us on a k1 visa don't have a credit score, in this case the uscis wants you to prove that s/he has none, so you should call transunion or equifax and request a letter from them saying that your fiance has no credit score with them. if he has SSN then i guess he can issue a free report online which will prolly show that he has no score or something, but you need to double check that cuz i am not sure how it looks.

Ask your fiance to check if in France they have some equivalent credit bureau that will issue a report on his credit.

Check the instructions of the form, if it says YOUR as opposed to YOUR OR YOUR HOUSEHOLD MEMBER then it means only the applicant's.

I think it'd be highly advisable to add him to your health benefits plan as soon as you get married and then apply.

His medical insurance abroad is useless if it doesn't cover him in the US, that is, for USCIS purposes of evaluating whether or not your fiance will become a burden to the US public aids.

As long as your marriage certificate is filed with the documents (birth certificate/passport), I don't see how you'd have any issues.
