Urgent Advice Needed on NVC fees

Hi everyone,

I need an urgent advice on a problem I am facing concerning my NVC fees.

NVC asked for two fees, one is IV fee , and the other is financial affidavit’s fee.

Apparently, I filled the petition for my wife, and another petition for my daughter, both petitions have them as primary beneficiary. At the point while filing, I didn’t see an option where my daughter’s petition could be added under my wife’s as “accompany”. Hence, I had to file another separate petition for her.

Recently, after both petition was approved by the USCIS, and it got to the NVC, I logged in to pay the fees starting with my daughter’s application, after I had finished paying her fees, I then moved on to paying my wife’s’ . This is when I noticed my daughter’s name appeared under my wife’s application as “accompany”, and it’s asking me to pay a fee for as to accompany my wife even though I had already paid her fee as a separate primary beneficiary. I have written USCIS since 15th of February, and by their time frame, I know this will take weeks to get a response.

This is why I need advice from anyone that might have experienced this kind of situation, I don’t mind paying the fees for her under my wife’s petition, but does this void her own application as a primary beneficiary? Do I have to cancel her application and have her under my wife’s application.

please advice.

Hi,

Since you are an LPR and the case for your wife is an F2a case, it allows for derivative beneficiaries.  You didn't have to a file a separate I-130 for your daughter.

Since you already paid the fee for your daughter, she can proceed with her separate case.  Under your wife's case, remove your daughter and let the NVC know that she has her own case.

If you cancel your daughter's case and continue with her under your wife's case, you will lose the fee you paid for your daughter's case and have to pay again to add her as a derivative on your wife's case.

That is what I thought too! Thank you for this
